MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owner, Joyce A. Marsters, Trustee of the Greenwood Trust <br /> 48 Greenwood Road, Map 117, Parcel 323 <br /> Mashpee, MA 02649 <br /> SP-2024-25 <br /> The new structure will comply with new building code criteria,and flood zone criteria.This project <br /> was approved by the Conservation Commission. There is no intensification of the existing non- <br /> conformities, and there are no new nonconformities being created. The applicant will be installing <br /> a new I/A system, and drywells. The existing front yard nonconforming setback to Greenwood <br /> Road will be eliminated. The proposed home is consistent with the redevelopment in the <br /> neighborhood, and the overall coverage of structures relating to total lot area is 8,000 sq. ft. and <br /> will be 22.9%which is less than 25%. The Board can find that this project is not more substantially <br /> more detrimental to the neighborhood than what currently exists. <br /> GENERAL FINDINGS <br /> The subject property located at 48 Greenwood Road has 8,000 sq. ft. of land. The minimum <br /> dimensional requirements in the Popponesset Overlay District are as follows: <br /> Minimum Lot Size—6,000 sq. ft. <br /> Minimum Frontage—60 feet <br /> Minimum Front Yard Setback—25 feet <br /> Minimum Side and Rear Yard Setbacks — 15 feet <br /> There were no abutters present. <br /> The Conservation Department comments dated June 6, 2024 were read into the record; "Resource <br /> Areas: Land Subject to Coastal Storm Flowage (LSCSF)NOI application for raze and replace of <br /> existing dwelling with installation of IA septic system,pervious parking area,pervious paver patio, <br /> drywells, native rain garden, tree planting, and relocation of shed. NOI application was approved <br /> unanimously at the May 9rh hearing date. " <br /> The Board of Health comments dated June 11, 2024 were read into the record; "Property is in <br /> Zone II. Current house has 2 bedrooms. No more bedrooms can be added unless 32,000 Sq. Ft <br /> Nitrogen Credit Landis deeded for that lot. Or 18,667 Sq. Ft NCL is deeded with the I/A system. <br /> BOH cannot allow 3.d bedroom. " <br /> Mr. Bonvie asked Mr. Rivera what year storm the overflow pipe complies with for the roof <br /> drainage, and does it comply with NOA or DEP Standards. Mr. Rivera stated that a 50, and 100 <br /> year storm. <br /> Mr. Goldstein asked if the cantilever was included in the lot coverage. Attorney Kirrane said that <br /> cantilever is always included in the lot coverage which is 22%, and is under the 25%requirement. <br /> There were no more comments from the Board. <br /> 2 <br />
