Town of Mashpee <br /> Y 16 Great Neck.Road North <br /> Mashpee, MA 02649 <br /> VW <br /> r 0 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2024-24 <br /> Owner, Schooner's Weigh, LLC Doc.: 1468486 <br /> 3 Elliot Road Ctf.: 231232 <br /> Map 117, Parcel 131 <br /> Mashpee, MA 02649 <br /> A Petition was filed on May 14, 2024 by Owner, Schooner's Weigh, LLC, requesting a Written <br /> Finding under §174-17 of the Zoning Bylaws to allow for a 196.56 sq. ft. addition to the front of <br /> the home and replacement of the existing deck to the rear of the home with a new 16 ft. x 16 ft. <br /> (256 sq.ft.)deck of a pre-existing,non-conforming dwelling,on property located in an R-3 Zoning <br /> District, and the Popponesset Overlay District, at 3 Elliot Road, Map 117, Parcel 131, Mashpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on May 10, 2024 and May 17, 2024 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,June 12,2024 <br /> at which time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, Jonathan <br /> Furbush, and Associate Member, George Ganzenmuller. <br /> Attorney Christopher Kirrane represented the property owner for the proposed project located at 3 <br /> Elliot Road. Also present was Raul Rivera with Cape & Island Engineering. This project is a <br /> request for a Written Finding for two additions; a rear deck, and a front covered deck. <br /> This property is located in the Popponesset Overlay District which has minimum dimensional <br /> requirements of 6,000 sq. ft. of lot area, 60 ft. of frontage, a front setback of 25 ft., rear and side <br /> setbacks are 15%,lot coverage requirement is 25%,and 50 ft. from the wetland resource area.This <br /> lot is wholly within coastal storm flowage, and for lots that are 10,000 sq. ft. or over,there is 0 sq. <br /> ft. lot coverage. The lot coverage is 100%, and the setback to wetlands is zero. There is a non- <br /> conforming front setback of 21.5 ft. from Shore Drive.
