MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Schooner's Weigh, LLC, Map 117, Parcel 131 <br /> Mashpee, MA 02649 <br /> FINDING-2024-24 <br /> The proposed additions comply with current dimensional requirements, and will be within 25 ft. <br /> from Elliot Rd for the front,and will be within 15 ft. from both side setbacks, and the deck will be <br /> 15 ft. from the property line of the rear and side setbacks. The 100 sq. ft. shed located on the site <br /> plan that is over the property line is being relocated. The overall increase in square footage with <br /> the additions is approximately 350 sq. ft. The increase in lot coverage is 22.2%which is less than <br /> 25%. The project was approved by the Conservation Commission, and there are no new <br /> nonconformities being created. <br /> GENERAL FINDINGS <br /> The subject property located at 3 Elliot Road has 10,053 sq. ft. of land. The minimum dimensional <br /> requirements in the Popponesset Overlay District are as follows: <br /> Minimum Lot Size—6,000 sq. ft. <br /> Minimum Frontage—60 feet <br /> Minimum Front Yard Setback—25 feet <br /> Minimum Side and Rear Yard Setbacks— 15 feet <br /> There were no abutters present. <br /> The Board of Health comments dated June 10, 2024 were read into the record; "5 bedroom house. <br /> 2 on the first floor and 3 on the second floor. Septic permit and installation in process for 5 <br /> bedroom. " <br /> The Conservation Department comments dated June 6, 2024 were read into the record; "Resource <br /> Areas: Land Subject to Coastal Storm Flow (LSCSF). Request for Determination of Applicability <br /> (RDA) application to replace existing rear deck, construct covered porch on front of dwelling, <br /> relocate shed, and add native plantings along Shore Drive lot line. Project received a negative <br /> determination at the April 18th hearing date with a vote of 4:1. " <br /> Mr. Furbush asked if the rinse station is being replaced or relocated. Mr. Rivera stated that the <br /> rinse station will be rebuilt on the new deck. <br /> Mr. Bonvie reviewed the building plans and asked if the house was recently built.Attorney Kirrane <br /> said that there are new dormers being constructed and some interior renovations. <br /> 2 <br />
