MA.SIIPEE ZONING BOARD of APPEAL <br /> MEETING MINUTES <br /> DECEMBER 1.4,2022 <br /> Mr. Thomas Bunker,with BSS Design represented the homeowner for a Special Permit request to <br /> raze an existing non-conforming single-family dwelling to be replaced with a conforming single <br /> family dwelling located on a 2.90 acre lot. The existing home is located 13.7 ft. from the south <br /> property line, and 43 ft. from the wetlands on.Johns Pond. The requirement is 15 ft. from the side <br /> yard setback, and 50 ft. from the wetlands. The new house will be constructed 15.5 ft. from the <br /> south property line, and 50 ft. from the wetlands. There is 400 ft.property line from Crescent Road <br /> that is not a defined right of way,and the house is 3 60 ft. from Crescent Road. There are two sheds <br /> on the property and one will be removed. The one remaining is 340 ft. from Crescent Road. The <br /> new house will comply with the setback requirements from the property line to the wetlands. The <br /> lot coverage is less than 20%. The project was approved by Conservation, and the septic system <br /> will be more than 100 ft. from.Johns fond. <br /> Mr. Bunker said that the septic system can be changed. The system is 100 ft. away and nitrogen is <br /> not a critical factor. <br /> Mr. Reidy read the Conservation Comments into the record; "this project was approved by the <br /> Commission at their November 10'h meeting. Board of Health comments read into the records <br /> "septic submitted is suitable for proposed dwelling." <br /> Mr. Morris said that the driveway will be subject to Section 174-32 which is the fire protection to <br /> be wider and a clearer height. The street and driveway will need to conform to fire access, and will <br /> be reviewed during the permitting process. <br /> There were no more comments from the Board, <br /> Mr.Goldstein made a notion that the Board approve 22 Crescent Road request for a Special Permit <br /> with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2.
