Mash ee MA 02649 <br /> �n x�,f� <br /> Itl" IlllrGIs, <br /> Ifl,�'w 66k�ii7inor.r�r�,w6 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 14,2022 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, December 14,2022, <br /> at 6:00 p.m. in the waquoit loom at the Mashpee Town Hall, 16 Great Neck road North. Acting <br /> Chairman, lion Bonvie, Scott Goldstein, Norman J. Gould, Associate Members, George <br /> Ganzenmuller, Charlie Reidy, Brad Pittsley, and Robert Caggiano were present. Building <br /> Commissioner, David Morris was also present. <br /> Mr. Bonvie opened the meeting at 6:00 pm and announced he will take comments after each <br /> hearing. The hearings were not televised because of equipment issues in the conference room. <br /> 5 Sheffield Place: Owners, Christopher P. and Donna M. Funk request a Variance under §174-31 <br /> of the Zoning Bylaws to vary the side yard setback to allow for a 200 sq. ft. shed on property <br /> located in an R-5 Zoning District, Map 29 Parcel 150,Mashpee, MA. <br /> The Building Commissioner reviewed the shed request back in April for zoning compliance <br /> purposes and determined that the placement of the shed required a Variance. Ms. Funk presented <br /> a site plan dated December 15, 2021 that depicted a hand-drawn 10 ft. x 20 ft. shed showing a 15 <br /> ft. setback from the side lot line. The Board was handed another site plan dated September 30, <br /> 2022 that depicted the shed setback 11 ft. from the side lot line. The homeowner would life the <br /> shed located in front of a concrete apron of an existing pool. <br /> Mr. Bonvie reviewed the hand-drawn site plan dated Dec. 15, 2021 and noticed that the concrete <br /> patio of the pool depicts a distance of 30 ft. from the property line, and 15 ft. plus 10 ft. for the <br /> width of the shed which would be 25 ft. This would allow 5 ft. <br /> Ms. Funk said the shed approximately 13 ft. from the fence, but she thought it was 2 ft. closer to <br /> the fence. The fence existed since 2003. Ms. Funk thought the shed was rather large and doesn't <br /> believe that the shed would fit in between the concrete pad and fence. <br /> Mr. Goldstein said that the concrete apron is not part of the setback, and if the setback is 30 ft. <br /> there should be enough roam to place the shed. <br /> Mr. Morris said a neighbor brought this the shed issue to his attention. He said that the pool and <br /> shed do not require a construction supervisor's license. The size of the shed requires a 15 ft. <br /> setback. <br /> Mr. Bonvie also discussed the site plan dated Sept. 30, 2022 depicting an issue with another shed <br /> and fence located in the rear that abuts Town property. Mr. Bonvie said that he is fine with the <br /> request for the new shed, but he cannot approve a plan that shows an encroachment on Town <br /> property. A new plan would need to be presented to the Board depicting the shed and fence either <br /> removed or relocated. <br /> 1 <br />
