MA HPEE ZONING BOARD of APPEALS <br /> MEETING MINUTES <br /> DECEMBER 14,2022 <br /> Ms. Funk said that her husband had a conversation with someone in the Conservation Department, <br /> and they did not encourage moving the fence at this time because it would disrupt the root system <br /> of the arborvitaes along the fence. <br /> Mr.Bonvie said that in order for this shed to be issued a certificate of compliance for the Variance, <br /> a revised plan would have to depict the existing building in compliance with the zoning setback <br /> required by the Zoning Enforcement Officer,and the fence showing the same. The new shed would <br /> also have to meet zoning. The old shed in the rear would have to be moved 5 ft. off the property <br /> line, and the fence moved onto the property line. <br /> Mr. Bonvie polled the Board, and all agreed that the old shed in the rear needs to be moved 5 ft. <br /> or greater off the property line, and to move the fence so it's on the property. The Board would <br /> require an as-built/site plan depicting these requested changes, and to return to the Board. <br /> Mr. Bonvie suggested that the application either be withdrawn without prejudice or extended. <br /> Ms. Funk requested to withdraw the application without prejudice. <br /> Mr. Goldstein made a motion to allow the applicant to withdraw the Variance request without <br /> prejudice for S Sheffield Place. <br /> Mr. Gould seconded.All were in favor of the withdrawal without prejudice of the Variance request. <br /> 134 Shore Drive West: Owners, Steven M. and Jill M. Purpura request a Variance under <br /> §174-33 (Setback from wetlands) of the Zoning Bylaws to allow for construction of a <br /> stairway to the beach on property located in an R-3 Zoning District, Map 132 Parcel 20, <br /> Mashpee, MA. <br /> fitting on this hearing are the three regular Board members, Mr. Pittsley and Mr. G anzemnuller. <br /> Attorney, Christopher Iirrane presented the application for the Variance request.Also present was <br /> Raul Lizard-Rivera with Cape and Islands Engineering. The Variance request is for the 50 ft. <br /> wetlands setback under Section 174-33 for the purpose of constructing a set of access stairs from <br /> the top of the coastal bank down to the beach. The structure will be approximately 4 ft. wide by <br /> 46 ft. long. This project was approved by the Conservation Commission at their last meeting. <br /> An Order of Conditions has not been issued yet, but Drew McManus revised his comments stating <br /> that before any work can be done, mitigation has to be completed. <br />
