MA HPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 14,2022 <br /> Attorney Kirrane concluded that the proposed redevelopment of this building is consistent with <br /> other redevelopment in the neighborhood, and is not substantially more detrimental than what <br /> currently exists. <br /> Mr. Reidy read the Board of Health and Conservation Department comments into the record; <br /> "Health Department needs septic plans for 4 bedroom house." "The Conservation Commission <br /> approved this project at their December Pmeeting." <br /> Mr. Reidy asked if the plans have been submitted. Mr. Gould asked if this system requires yearly <br /> maintenance. <br /> Mr. Lizard i-Rivera said that the innovative system is an enhanced nitrogen reducing septic system, <br /> and requires a maintenance and inspection report submitted to the Board of Health. There has not <br /> been an agreement as of this date, but once the Board of Health has agreed to the septic plans it <br /> will be finalized. There are no requests for variances, but requires a septic system permit. The <br /> permit will be submitted after the applicant has a conversation with the Board of Health. <br /> Mr. Bonvie said that historically an applicant will submit septic and site plans to the Beard of <br /> Health for approval prior to submitting an application with the Zoning Board of Appeals. If the <br /> Board of Health does not agree to the proposed location on the plan, or the type of innovative, <br /> septic design, it will require another meeting with the Zoning Board of Appeals. <br /> Mr. Bonvie asked if the septic system design is an approved innovative system.Mr.Lizardi-Rivera <br /> said that it's an approved technology, and has permits with DER Mr. Bonvie stressed that all <br /> approvals should be made prior to an application with the ZBA. <br /> Attorney Kirrane said that the Board could condition upon submittal of the septic plans to the <br /> Board of Health. <br /> Mr. Bonvie palled the members for comments. There were no more comments from the Board of <br /> Building Commissioner. There were no comments from the audience. <br /> Mr. Gould made a motion that the Board approve the Special Permit request for 2 Cross Tree way <br /> with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2. Site Plan —2 Cross Tree way, Prepared for.
