MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> NOVEMBER 9,2022 <br /> Mr. Furbush mentioned that this past July,the Board approved the changes the sale units to rental <br /> units. Mr. Freeman said that Condition 23 is the limited dividend provision that the applicant <br /> complies, and that the subsidizing agency cost certifications at the end that have not been in place <br /> yet because this ongoing. There is no need for a modification on this particular condition because <br /> the compliance with cost certification and limited dividend provision is up to the subsidizing <br /> agency. <br /> Mr. Feronti said that in Phases 2 through 7 are for sale, there are more than 191 units in those <br /> phases. <br /> There were no more comments from the audience or the Board, and no comments from Mr. Pesce. <br /> Mr. Goldstein made a motion that the Board accept Mashpee Commons Limited Partnership <br /> (MCLP),and Jobs Whiting Trust(JWT)request approval of the Final Site Plans dated October 28, <br /> 2022 for sub-phases 113, IC, and 1 D of the buildout of Phase 1. In accordance with Section IV: <br /> Decision& Conditions of the Chapter 40B Comprehensive Permit. <br /> • Conditioned on all Town Department comments read into the record. <br /> • Conditioned that Mashpee Commons provide the engineering escrow account be <br /> replenished to a total of$10,000. When it is reduced to $2,500 total, it will be replenished <br /> to $5,000 total. <br /> • Conditioned that all comments by Pesce Engineering current and future be addressed and <br /> approved by Pesce Engineering. <br /> • Conditioned on any future comments from Mashpee Police Department be addressed and <br /> approved by the Mashpee Police Department. <br /> • Conditioned that all the final civil engineering design plans, landscape design plans, and <br /> proposed lighting plans to be provided for review and approval by Pesce Engineering prior <br /> to issuance of a building permit given the time between now and then to do that. <br /> • Conditioned on Exhibit A Mashpee Commons-Jobs Whiting Neighborhood administrative <br /> design review plans dated October 28, 2022, Sheets 1 through 22 prepared by Union <br /> Studio.
