Town of Mashpee <br /> a <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> NOVEMBER 9,2022 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday,November 9, 2022, <br /> at 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck Road North, <br /> Chairman,Jonathan D. Furbush, Board Members William A. Blaisdell, Scott Goldstein,Norman <br /> J. Gould, Associate Members Sharon Sangeleer, George Ganzenmuller, and Robert Caggiano <br /> were present. Building Commissioner, David Morris was also present. <br /> Chairman Furbush opened the meeting at 6:00 pm and announced that the hearings were being <br /> televised live on Mashpee TV. He will take comments after each hearing. <br /> NEW HEARINGS <br /> 44 Waterwa : Owners, Linda H. and David A. Pierce request a Special Permit under §174-17.1 <br /> of the Zoning Bylaws to raze and replace an existing non-conforming single family dwelling on <br /> property located in an R-3 Zoning District, Map 105 Parcel 208, Mashpee, MA. <br /> Sitting on this hearing were the four regular Board members and Mr. Ganzenmuller. <br /> Attorney, Christopher Kirrane represented the homeowners for their raze and replace application. <br /> Also present was Tim Luff, with Archi-Tech Associates. The Attorney provided a site plan <br /> depicting the current 1968 dwelling layout, and the proposed dwelling layout. The property is non- <br /> conforming in three ways. The front yard setback is only 5 ft. 9 inch, the northerly side yard is <br /> only 11.6 ft. off that property line, and the lot coverage is non-conforming at 22.5%, and the <br /> maximum allowed is 20%. <br /> The proposed dwelling consists of a new code compliant structure that will be serviced by a new <br /> Title 5 Septic System. There will be an improvement to the front yard setback from 5.9 ft. to 20.8 <br /> ft., and will be eliminating the side yard setback. The lot coverage will remain the same at 22.5%. <br /> There are no new non-conformities being created. There will be a new garage, and a secondary <br /> driveway that will provide plenty of off-street parking. This project was approved by the <br /> Conservation Commission with 1,700 sq. ft. of mitigation plantings towards the water's edge. <br /> The Board received comments from the Town Planner regarding storm water management. <br /> Attorney Kirrane mentioned that there are three infiltration areas to capture any roof runoff onsite. <br /> The Attorney will not be opposed to any condition that the Board requires to keep all storm water <br /> runoff onsite. The overall pervious material will be reduced by 120 sq. ft. from what currently <br /> exists now. <br /> 1 <br />
