<br /> <br />MASHPEE ZONING BOARD OF APPEALS <br />JANUARY 23, 2013 <br />MINUTES <br /> <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, January 23, <br />2013, at 6:00 p.m. in Conference Room #2 at the Mashpee Town Hall, 16 Great Neck <br />Road North. Board Members Jonathan D. Furbush, William A. Blaisdell, Judith M. <br />Horton, and Associate Member Domingo K. DeBarros were present. Building <br />Commissioner Richard E. Morgan was also present. Board Members Ronald S. Bonvie <br />and James Reiffarth and Associate Member John M. Dorsey were unable to attend the <br />meeting. <br /> <br />Chairman Jonathan D. Furbush opened the meeting at 6:00 p.m. He stated that the Board <br />consists of only four Members tonight and a unanimous vote is required for any Petition <br />to be granted. He offered the Petitioners the choice of continuing until there is a five- <br />member Board present. <br /> <br />NEW HEARINGS <br /> <br />Barry A. and Lois S. Sahl: Request a Variance from §174-31 of the Zoning By-laws to <br />vary the rear setback requirements to allow for construction of an addition and garage <br />onto a dwelling on property located in an R-3 zoning district at 7 Chicory Circle (Map 89 <br />Parcel 28) Mashpee, MA. Board of Health comments: Not in Zone II. The dwelling is <br />restricted to four bedrooms. Not within Conservation Commission jurisdiction. Per <br />Building Inspector Charles R. Maintanis, this property lies within a cluster subdivision <br />with lot coverage of 30%, front setback of 30’, side setback of 15’, rear setback of 20’. <br /> <br />On January 23, 2013, the ZBA office received a request from Attorney Kirrane <br />requesting a continuance of the above-referenced Petition until there is a full Board of <br />five Members. Mr. Blaisdell made a motion to continue the Petition until February 13, <br />2013. Mr. Furbush seconded the motion. Votes: Mr. Furbush, yes. Mr. Blaisdell, yes. <br />Ms. Horton, yes. Mr. DeBarros, yes. Vote was unanimous. <br /> <br />Jason A. and Tara A. Andrade: Request a Written Finding under §174-17 of the <br />Zoning By-laws and M.G.L. Chapter 40A §6 concerning continuance, extension or <br />alteration of pre-existing, non-conforming structures to allow for renovation of an <br />existing deck into an enclosed porch on a dwelling located on property in an R-3 zoning <br />district at 2 Huron Avenue (Map 65 Parcel 16) Mashpee, MA. Board of Health <br />comments: In Zone II. The proposed enclosed porch is restricted to a three season porch, <br />unheated. Not within Conservation Commission jurisdiction. <br /> <br />Mr. and Mrs. Andrade chose to have their Petition heard tonight by the four Board <br />Members present. Mrs. Andrade said that the proposal calls for enclosure of the pre- <br />existing, non-conforming 10x12-foot deck with three walls and a roof. There are no <br />plans to heat this area. Mrs. Andrade said that most of the neighbors have enhanced their <br />dwellings with a similar addition. Mr. Furbush questioned the distance from the closest <br />point of the proposal to the abutting property line. Mr. Morgan confirmed that the <br />distance is 10 feet away.
