401 Nathan Ellis Highway (continued)

 Walter noted that the approved and proposed Plan differ from what exists. In new plan, back
of building is extending into the parking lot. Walter commented that we don’t know whether
expansion goes into parking, into walk-way, or where.
 Tom Fudala said Dino has a problem because one architect doing plan and other architect
working on expansion.
 Walter questioned lighting to be used. Steve Daley responded the unit can hold whatever
lights are needed.
 Walter explained complication of egress locations under the new proposal.

Comments

 Need existing/proposed site plan.
 Front elevation showing the outline of the existing building and the proposed addition on it.
 Site Plan with this proposal on a Plan. Gate has to be revised—not wide enough.
 Now have setback issues to lot line—2 abutting properties owned by same people.
 Building code issues to be dealt with following approval.
 Narrative to existing building code.
 Down the road would need to look at Fire Department access issues.
 Need engineering and site plan.
 Need to show parking on site plan. Needs additional parking for additional seating.
 Glen Harrington advised Dino has to close a portion of the restaurant to be able to do this
expansion because it is Zone 2. He has to keep restaurant design flow septic-wise the same.
 Charlie noted there are occupant load requirement in the building code.
 Glen said plan should show what portion of the restaurant will be closed. Walter added the
plan should show what seating is there and how 24 seats are being removed. Glen said Board
of Health looks at absolute seating.

Catherine Laurent suggested it might be helpful if something were sent to Dino in writing.

Joyce Mason said she would write a letter to Dino and she suggested that perhaps Building/Fire
could meet with Dino to explain what would be needed with the additional seating prior to his going to
the Board of Selectmen. Tom Fudala said the architect should be involved.

Joyce proposed delaying Planning Board review. She said it is in Dino’s best interests to have pre-
meeting to go over what is needed. Charlie suggested Dino should also bring his architect to the
meeting. Glen Harrington commented that Dino had said he doesn’t want to go down so far and then
find out he can’t do it, so he would appreciate knowing this information before going forward.

Joyce stated we have an obligation to point out the issues we see at this point. Steve Daley said if
this were my property I would appreciate knowing what you folks have offered.

Conclusion

Motion: Joyce Mason motioned to continue until Building Department meeting with Dino Mitrokostas
is held and proper plans are submitted; Scott Carline seconded this motion; and it was unanimously
passed by Design Review and Plan Review Committee.

2
