M <br /> N . <br /> MINUTES September 16, 1993 2 BOARD OF HEALTH <br /> Mr. Miller requested Board members continue this hearing <br /> pending revised plans which delineate all abutting lots <br /> within 150' of the proposed leaching facility and verifica- <br /> tion from the Water District as to which abutters are tied in <br /> to public water. <br /> Board members agreed to the continuance. <br /> Mr. Greelish questioned the depth to groundwater indi- <br /> cated on the perc test, (101 ) . Mr. Greelish directed the <br /> Agent to research the depth to groundwater indicated on perc <br /> tests performed on abutting lots. " <br /> APPOINTMENT: 18 Uncle Henry's Road <br /> Mr. David Sanicki, P.E. was in attendance for this <br /> scheduled appointment. There were no abutters in attendance. <br /> Mr. Sanicki presented certified mail receipts and re- <br /> layed, "Lot 11 is under bank foreclosure. " "The owner of lot <br /> 13 has agreed to tie in to town water. " "This is a proposed <br /> 3 bedroom house. " "The owner is requesting a 50' local vari- <br /> ance from abutting well, (lot 11) , to the proposed on-site <br /> leaching facility and a 25' local variance from abutting <br /> well , ( lot 5) , to the proposed on-site leaching facility. " <br /> Mr. Greelish motioned to grant the variances as re- <br /> quested with the stipulation an Agent of this Board notify <br /> the Bank of the variance relief, Mr. Ball seconded, all <br /> agreed. <br /> 3 . ) Memo from Building Inspector re: "Oak Groves" - Mr. <br /> McQuaid relayed, . "Based on the information received by this <br /> office we cannot deny plans. " <br /> Mr. Greelish stated, "This Board does not rule- on zoning <br /> issues however, if we are made aware of a nonconforming zon- <br /> ing situation we cannot ignore it. " "We cannot approve a <br /> nonconforming use. ,, <br /> Mr. McQuaid commented, "I would recommend the Board for- <br /> ward a memo to the Planning Board stating due to extenuating <br /> circumstances involved in this subdivision which deal with <br /> zoning issues, the Board will withhold its decision until the <br /> matter is resolved. " <br /> Board members agreed with Mr. McQuaid's recommendation. <br /> 4. ) Memo from Exec. Secretary re: Recycling Services con- <br /> tract - Mr. Greelish stated, "I am requesting that all time <br /> spent and funds expended such as payment to Weston & Sampson, <br /> be accounted for separately.
