" "We did <br /> find floating product in the wells which is why we decided to <br /> take immediate action so we decided to do a pilot study. " <br /> "The purpose of the pilot study was to put in three different <br /> systems to test their performance so we would know if we put <br /> in a vacuum extraction well how far away, what the rate is of <br /> influence and how far away the pressure would be felt so we <br /> would know how many of them to install to take up that space <br /> and remediate that entire site. " "That pilot study has not <br /> been completed. " "There were three systems that were tested, <br /> vapor extraction, air sparging and free product recovery. " <br /> "They were successful in all three tests. " "The design is <br /> due for my review some time in December which means it should <br /> be ready for public review and bidding by the first quarter <br /> of next year. " <br /> Mr. Doherty questioned Mr. Pesce as to what the flow <br /> rate is at the advancing end of the plume. <br /> Mr. Pesce responded, 111.1' per day. " "It varies <br /> throughout the region from 1' to 1 1/2' per day. " <br /> Mr. McQuaid questioned- Mr. Pesce as to whether a pump <br /> and treat system is proposed. " <br /> Mr. Pesce responded, "At this point it would be consid- <br /> ered a pump and treat system. " <br /> DISCUSSION - BRIARWOOD AREA <br /> Mr. Pesce stated, "The Guard Bureau has received a "No- <br /> tice of Intent" for a law suit from 820 residents in the <br /> Briarwood area. " "We have been ordered to cease all conver- <br /> sations on what the government can or cannot do for this <br /> area. " <br /> Mr. Greelish stated, "It is my understanding the only <br /> way anyone can sue or bring class action against the govern- <br /> ment is by authorization from Congress. " "There is a provi- <br /> sion in the E.P.A. statute that allows that if you do not <br /> follow all the bits and pieces of the superfund site <br /> remediation inspection, study, etc. then you are liable how- <br /> ever, as long as you follow that criteria and you are not <br /> faulted by the E.P.A. then you are still exempt as a federal <br /> entity. " "One of the things this additional influence has <br /> kicked off is that at a recent meeting it was indicated that <br /> that was the perception of the Guard Bureau at the time. " <br /> ,,it looked like it would beat that criteria and that the <br /> Guard Bureau would in fact enter into negotiations. " "Nor- <br /> mally it would enter into negotiation with the previous party <br /> which was the Water District. " "I would recommend this Board <br /> request, as the prevailing governmental body in the town of <br />
