MINUTES November 18, 1993 2 BOARD OF HEALTH <br /> "They were estimating that our trucking costs would go from <br /> 7.81/ton to 12 . 62/ton. " "We did contact Bay Colony and after <br /> much discussion it was agreed they would transport the refuse <br /> for the fee stated in the contract. " "The bridge will be out <br /> of commission for six weeks. " <br /> Acknowledged. <br /> APPOINTMENT: Eagle Eng. - 97 Shore Drive <br /> Attorney Robert Mills, Mr. Roger Michniewicz, P.E. , Mr. <br /> & Mrs. Rosetti and Ms. Sophie Selades, abutter were in atten- <br /> dance for this scheduled appointment. <br /> Mr. Michniewicz presented revised plans and stated, "The <br /> project consists of a 6 , 500 square foot lot. " "The lot <br /> starts at elevation 10 in the rear and drops down to ap- <br /> proximately 5 1/2 towards the front. " "Due to the small di- <br /> mensional nature and terrain of the lot I do not believe any <br /> leaching facility could be installed without Title V <br /> variances. " "The owner is requesting a local variance from <br /> the regulation which requires 4' of permeable soil between <br /> __.. the bottom of the leaching facility and groundwater, a State <br /> variance from the regulation which requires removal of un- <br /> suitable soil within 25' of the proposed leaching facility, a <br /> variance from break-out criteria, State sideline variances <br /> and a perc extension. " "We are proposing a concrete cutoff <br /> retaining wail with a 30 mil p.v.c. liner to be attached to <br /> the inside which will create an impermeable barrier down to a <br /> depth that will get below the grades that break-out will no <br /> longer be a problem. " "The wall is proposed to be completely <br /> buried in its finished condition. " <br /> Attorney Mills stated, "This lot and all the adjacent <br /> lots are also served by town water. " "I represent Mr. Joseph <br /> Rosetti on his application for a variance to local depth to <br /> groundwater regulation. " "Due to the nature of the subsur- <br /> face conditions my client is unable to meet the 4' separation <br /> recited in the regulation. " "Additionally, other variances <br /> under Title V are required in order for my client to finally <br /> construct a home he has been putting off for over 31 years. " <br /> "The property was acquired by Mr. Jerry Rossetti in 1962 for <br /> the purpose of building a family retreat. " "That same year <br /> the thought of going forward with construction plans dissi- <br /> pated with the passing of Jerry Rossetti . " "At that junction <br /> my client assumed full responsibilities over the family busi- <br /> ness and plans to construct on the subject locus were de- <br /> layed. " "In 1972 Joe Rossetti's son was involved in a near <br /> fatal automobile accident with resulting serious and <br /> permanent injury. '$ "Joe devoted the next 20 years towards <br /> getting his son to a point of self-sufficiency. " "In fact, <br /> my client attended every single class at Providence college <br />
