" "We did contact Bay Colony and after much discussion it was agreed they would transport the refuse for the fee stated in the contract. " "The bridge will be out of commission for six weeks. " Acknowledged. APPOINTMENT: Eagle Eng. - 97 Shore Drive Attorney Robert Mills, Mr. Roger Michniewicz, P.E. , Mr. & Mrs. Rosetti and Ms. Sophie Selades, abutter were in atten- dance for this scheduled appointment. Mr. Michniewicz presented revised plans and stated, "The project consists of a 6 , 500 square foot lot. " "The lot starts at elevation 10 in the rear and drops down to ap- proximately 5 1/2 towards the front. " "Due to the small di- mensional nature and terrain of the lot I do not believe any leaching facility could be installed without Title V variances. " "The owner is requesting a local variance from the regulation which requires 4' of permeable soil between __.. the bottom of the leaching facility and groundwater, a State variance from the regulation which requires removal of un- suitable soil within 25' of the proposed leaching facility, a variance from break-out criteria, State sideline variances and a perc extension. " "We are proposing a concrete cutoff retaining wail with a 30 mil p.v.c. liner to be attached to the inside which will create an impermeable barrier down to a depth that will get below the grades that break-out will no longer be a problem. " "The wall is proposed to be completely buried in its finished condition. " Attorney Mills stated, "This lot and all the adjacent lots are also served by town water. " "I represent Mr. Joseph Rosetti on his application for a variance to local depth to groundwater regulation. " "Due to the nature of the subsur- face conditions my client is unable to meet the 4' separation recited in the regulation. " "Additionally, other variances under Title V are required in order for my client to finally construct a home he has been putting off for over 31 years. " "The property was acquired by Mr. Jerry Rossetti in 1962 for the purpose of building a family retreat. " "That same year the thought of going forward with construction plans dissi- pated with the passing of Jerry Rossetti . " "At that junction my client assumed full responsibilities over the family busi- ness and plans to construct on the subject locus were de- layed. " "In 1972 Joe Rossetti's son was involved in a near fatal automobile accident with resulting serious and permanent injury.
