MINUTES July 7, 1994 4 BOARD OF HEALTH
gives a minimum cushion. " Should Mr. Sherman verify the
103 ' distance from the wetlands then the reserve area will be
less than 100' from the wetland area. " "Should the Board
tentatively grant the requested relief then I would recommend
Mr. Sherman verify the 103' distance and the Board look at
the architectural plans of the building to ensure the dwell-
ing is a two bedroom house as a den could be converted to an
additional bedroom which the system cannot accommodate. "
Mr. Doherty motioned to grant a 43' local variance from
the on-site proposed leaching facility to abutting well ,
(Behrman residence) and a 10' State sideline variance with
the stipulation the Conservation Commission agent verify the
distance from the wetlands as delineated on plans and an
agent of this Board review architectural plans prior to
sign-off on the building permit, Mr. Cram seconded, all
agreed.
APPOINTMENT: Richard Halpern - Smoking Regulation
Mr. Halpern was not in attendance for this scheduled ap-
pointment.
Mr. McQuaid relayed, "There are three food establish-
ments in town that have not removed their cigarette vending
machines. "
Mr. Ball directed the agent to forward a certified let-
ter to all three food establishments ordering the removal of
their cigarette vending machines within 7 days from the date
of the certified mail receipt, upon expiration of the allot-
ted time frame a fine shall be instituted for each subsequent
day the violation continues, Mr. Doherty seconded. Mr. Cram
opposed.
4. ) Household _Hazardous Waste Collection update - Mr.
McQuaid relayed, "I met with Adrea Adams of the Commission
yesterday. " "Three companies submitted bids; Clean Harbors,
Laidlaw and Triumverate Environmental. " "As there was only
$170 . 00 difference between Laidlaw and Triumverate I did rec-
ommend to Ms. Adams that we go with Triumverate due to the
outstanding job done with our previous collection day. " "Our
share will be based on the number of cars from Mashpee. "
"We do need volunteers for that day. " "All small quantity
hazardous waste generators in town will be notified." "They
are invited to participate and will pay for their disposal
directly to the company." "Ms. Adams is working on a news
release. "
