MINUTES July 20, 1995 3 BOARD OF HEALTH
Mr. McQuaid relayed, "Mr. Spohr's mother is requesting the Board to reconsider
our previous comments on this piece of property she owns." "Ms. Spohr was involved in
getting this permitted through Charlie Spohr and then through Jack Landers-Cauley."
"The latest motion from the Board was to allow Ms. Spohr to put in a septic system on
another piece of property, which she owns, 100' away from the abutter's well, in that she
owns this property and at the time owned the other piece of property." "This is a private
dirt road which she owns to the center of the road." "The Board of Health at the time had
no problem with that, in that a precedent had already be set allowing a septic system or
well being placed on an abutting commonly owned piece of property." "Mr. Spohr
informed me the ownership has been changed in that Ms. Spohr still owns the two lots
however, she deeded the third lot over to her daughter so now, it's not under common
ownership."
Mr. Spohr commented, "My sister's son, who is a minor, makes it very, very
difficult to change the ownership back."
,Mr. McQuaid relayed, "I my opinion, Mr. Spohr should proceed with his attorney
to arrange some kind of easement granting your sister easement to your mother's property
in perpetuity to install a septic system."
Mr. Doherty stated, "I would accept that however, I recommend you consider an
alternative septic system."
Mr. McQuaid relayed, "I would recommend, if you intend to submit plans, you
bring your engineer and attorney.
3.) F.Y. `96 Fin. Comm. Liaison - Acknowledged.
4.) Food Service Permit - The Center for Optimum Care - Mr. McQuaid relayed,
"Mr. Evans inspected approved the license." "The screens in the kitchen were the only
things lacking."
Mr. Ball motioned to grant a 1995 Food Service Permit to the Center for Optimum
Care, Mr. Cram seconded, all agreed.
5.) Proposed Fall Town Meeting article revised - Mr. Ball motioned to enter the
article in the October Town Meeting warrant, Mr. Cram seconded, all agreed.
6.) Letter to D.E.P. re: Transition Statement - Mr. Doherty signed the letter.
I
