MINUTES December 21, 1995 3 BO-ARD OF HEALTH <br /> 5.) Emergency failure certification, 27 Lakewood Drive - Mr. Evans relayed, "I <br /> inspected the property and found sewage backing up into the basement." "l did authorize <br /> immediate repair." <br /> Beard members forwarded their signatures to the "Emergency Repaj; <br /> Certification" form. <br /> 6.) Variance request 5l BEayshore Drive and 29 Sheffield Place <br /> 51 )BAYSHORE DRIVE - Mr. McQuaid relayed, "In order for the owner to maintain <br /> 100' from the wetland area they are requesting a 5' sideline variance." <br /> Mr. Cram motioned to grant the 5' sideline variance as requested, Mr. Ball <br /> seconded, all agreed. <br /> 29 SHEFFIELD PLACE - Mr. McQuaid relayed, "This is a preapproved subdivision <br /> with well and septic layouts." "The 150' separation cannot be met due to a right-of-way <br /> cul-de-sac." <br /> Mr. Cram stated, "The engineer has not indicated the variance(s) they are <br /> requesting." <br /> Mr. Cram motioned to deny variance relief without prejudice based on incomplete <br /> plans, Mr. Doherty seconded, all agreed. <br /> 7.) "Access" eoLnputer course offerin - Acknowledged. <br /> 8.) Illegal damping, Morley - Mr. McQuaid relayed, "As you recall, I found a <br /> pocketbook amongst the illegal dumping debris." "I brought the letter over to the police <br /> department and an officer put it in the pocketbook." "The won.en did pick up her <br /> pocketbook with the letter in it." "At that time I informed Board members and it was <br /> decided we should forward a certified letter anyway." "The certified mail was sent <br /> November 17, 1995 and 21 days has since elapsed." "The debris has not been cleared up." <br /> "She does have a court record." "I would recommend we pursue this matter by taking it <br /> to court." <br /> Board members directed Mr. McQuaid to continue 1Aith court proceedings. <br />
