R <br /> MINUTES May 27, 1999 2 BOARD OF HEALTH <br /> Mr. Doherty motioned to grant the variance of 30' from the proposed leaching to <br /> the abutting well of house #14 and a 32'variance from the proposed on site <br /> reserve to the abutting well of house #207. Mr. Cram seconded the motion. <br /> Motion passed. <br /> Opening of RFP for the Transfer Station <br /> Mr. Doherty presented a statement from the Ethics Commission regarding his <br /> request for a determination on invoking the Rule of Necessity for the opening of <br /> proposals for the Transfer Station operation. <br /> Mr. Doherty stated, "Essentially what the letter says is that when a Board loses <br /> its quorum and cannot act on an issue because of the loss of quorum, the Rule <br /> of Necessity can be invoked." <br /> Mr. Doherty motioned to forward a letter to Town Counsel requesting an <br /> opinion as to whether the Board can invoke the Rule of Necessity. Mr. Cram <br /> seconded the motion. Mr. Ball was opposed. Motion passed. <br /> Mr. McQuaid stated, "Bids will be opened publicly on June 1, 1999 at 10:00 <br /> a.m. This item will be on the agenda for the next meeting for the Board to <br /> render a decision. Copies of each proposal will be given to each Board member <br /> Tuesday afternoon." <br /> APPOINTMENT Michael Grotzke re: Brickyard Market 1p ace <br /> i <br /> Mr. Grotzke was in attendance for his scheduled appointment. <br /> Mr. Grotzke stated, "This project is within the Zone 2 area. The owner would <br /> like to have the option to upgrade to a FAST treatment system so we can go to <br /> 550-gallons per day instead of the 440-gallons." <br /> Mr. McQuaid stated, "The only time the Board has ever considered granting a <br /> variance to the center line of a private road is when we are granting an <br /> easement. The Board has never been asked to consider increasing the square <br /> footage of the assessed square footage of any given lot to include up to the <br /> center line of any private road." <br /> Mr. Ball requested that Mr. Grotzke submit revised plans omitting the Route <br /> 151 center line. <br /> Mr. Doherty motioned to continue the requesting pending revised plans.
