TOWN OF MASHPEE <br /> BOARD OF HEALTH <br /> September 2, 1999 <br /> Board of Health Meeting was called to order at 7:05 p.m. <br /> Members present: Steven R. Ball, Chairman, <br /> Robert F. Cram, Sr., <br /> Elias A. McQuaid and Veronica A. Mayer <br /> THE TAPE IS NOT PART OF THE MEETING; IT IS FOR THE PURPOSE OF <br /> TRANSCRIPTION ONLY. <br /> Mr. Steven R. Ball, Chairman <br /> 1. Sign warrants. Warrants signed. <br /> 2. Approve Minutes of July 29, 1999 Meeting <br /> Mr. Cram motioned to accept the minutes of July 29, 1999. Mr. Ball seconded <br /> the motion. Motion passed. <br /> APPOINTMENT: Tom Leone General Managing Partner, 99 Restaurant <br /> Mr. Tom Leone was in attendance for this scheduled appointment. <br /> Mr. Tom Leone, 99 Restaurant, was present to discuss their options in regards to <br /> putting a small addition on the side of the building. He noted that the 99 Restaurant <br /> is a busy restaurant with sometimes having a wait time of 1-1/2 to 2 hours. He noted <br /> that this is why he would like to expand slightly - to eliminate some of the long waits. <br /> Mr. Leone stated that he would like to find out from the Board if this expansion is <br /> possible. <br /> Mr. McQuaid stated that he had talked to Mr. Leone a while back on this issue. At <br /> that time, Mr. McQuaid suggested to Mr. Leone that the Board might consider that 99 <br /> Restaurant put in a denitrification unit in the interest of public relations and the <br /> concern about the health of the Mashpce River. Mr. McQuaid stated that in Title V, <br /> the section that allows the Board to grant a credit of 25% should only be considered <br /> when there are constraints on the lot due to the size of the lot or the proximity to <br /> wetlands. Mr. McQuaid stated that there are not constraints on the lot. <br /> Mr. McQuaid stated that the other issue, which is worthy of bringing up, is their <br /> actual water usage. Mr. McQuaid stated that their water usage falls way below the <br /> Title V calculations of 35 gallons per seat per day. <br /> Mr. McQuaid commented that if you take the two factors noted above, their <br /> application for a variance is worthwhile. However, Mr. McQuaid noted that if the <br /> Board does decide to pursue this application for a variance, it would have to be <br /> approved by the DEP because it is not an upgrade of a failed septic system and it is <br /> not due to constraints of the lot size.
