Box 455 Barnstable, MA 02630 November 26, 1999 Re: Massachusetts Public Records Law Violations, Mashpee, MA Dear Sirs, 1, herewith, request enforcement of the Commonwealth's laws relating to Public Records. The initial facts are summarized in my letter to the Mashpee Board of Health dated . November 15, 1999 hand delivered to the Health Office on the morning of the letter date. I returned to the Health Office on Friday morning November 26,1999 and asked for any documents that were available for me. I was told of a Board of Health letter and given an unsigned copy as a courtesy. I received none of the requested documents. On that Friday afternoon, a neighbor gave me the mis-delivered letter she had received a few hours earlier. It was the Health Dept. letter dated November 23, 1999 and postmarked 11/24/99 PM. It is a direct and purposeful trampling of my rights under law. I am especially aggrieved and suspicious, as following denial of my verbal request on November 12, 1999, I went to the Town Clerk's Office and complained about the refusal. I am certain the Town Clerk advised the Health Office they were required to comply with my request under the law. I can only speculate regarding the Health Office's intent in this matter. As a related issue to the Public Records violations, I request a full investigation of the Board's motivation in this matter. i i I believe the following violations are obvious: I ' Apparent destruction of meeting tapes with an outstanding Public Records request. Failure to provide requested available public documents within ten(10) consecutive days. Refusal to provide draft minute copies. Approved copy not in existence. Requirement for written request.
