Ball, Chairman <br /> I <br /> i - <br /> I <br /> APPOINTMENT: Ed Eichner of the Cape Cod Commission re: Informational <br /> Discussion/Presentation on the Designation of Nitrogen Sensitive Areas and Nitrogen <br /> Limitation Re lations. <br /> Mr. Eichner was in attendance for this scheduled appointment. <br /> Mr. Eichner addressed the issue of nitrogen sensitive area designations and the <br /> existing regulation of the Board for septic systems greater than 600 gallons per day. <br /> Mr. Eichner then outlined some the pros and cons of designating Nitrogen Sensitive <br /> Areas with some of the highlights as follows: <br /> Pro: Better protection of coastal embayments. <br /> Pro: Boards of Health permitted to designate these areas under Title V. <br /> Con: DEP has not designated any such areas. <br /> Pro: Not currently many small buildable lots that would be rendered <br /> unbuildable. <br /> Con- Having asked certain property owners to install denitrification units and <br /> to then ask them to connect to Town Sewer may be difficult. <br /> Con: Do not wish to impede Sewer Commission plans. <br /> Con: Watersheds overlap into surrounding towns (Cotuit & Falmouth). <br /> Con: Would only affect new construction. <br /> Mr. Eichner also outlined specifics of the Mashpee Board of Health's current local <br /> nitrogen limitation regulation as follows: <br /> • Specifies May 10 ppm million effluent for systems above 600 gpd. <br /> • Cannot be achieved by conventional Title V systems (35-50 ppm nitrogen) or <br /> denitrification systems (19 ppm) <br /> • Can be achieved by advanced tertiary wastewater treatment plants. <br /> • Requires monitoring wells (currently at property line - should monitoring <br /> occur at effluent discharge point?) <br /> • Suggests using Cape Cod Commission nitrogen loading formula as prepared <br /> by DEP <br /> • (Mr. Eichner to send the Board of Health draft regulation for review) <br />
