70tfr1f t";t
TOWN OF MASHPEE S `f . •; :i
BOARD OF HEALTH , _ a
October 26, 2000 , 10. 2 r
Meeting was called to order at 7:00 p.m.
Members present: Steven R. Ball, L. Glenn Santos, and Veronica A. Warden
THE TAPE IS NOT PART OF THE MEETING; IT IS FOR THE PURPOSE OF
TRANSCRIPTION ONLY.
Mr. Steven R. Ball, Chairman
1. Sign warrants. Warrants signed.
2. Approve Minutes of October_12,_2000 meetings
Approval of minutes was postponed until a full Board is present.
3. Letter from J&R Sales re: Denite O&M contract: 15 Tide Run and draft letter
responso
Ms. Warden stated that the testing of their denitrification unit is a state
requirement and that the Board of Health can fine the owners for non-
compliance of a Title V regulation.
The Board acknowledged the letter from J&R Sales and directed Ms. Warden to
send a letter to the owners of 15 Tide Run stating that they are in violation of
310 CMR 15.000 and that they have 14 days in which to respond to the letter
or they will be subject to fines.
4. Variance request -- 55 Wood Road
Ms. Warden stated that this variance request had been reviewed by George
Heufelder of Barnstable County Department of Health and the Environment.
He felt that the local engineering firms had not been following Title V
regulations. There is no general use for a FAST system, only provisional use.
Provisional use is contingent upon State approval. This variance request,
which the Board has granted in the past, needs to go to the State for approval.
The reason is that the lot has a private well and therefore it falls under the
January 1, 2000 Title V change. The Board can approve the local variances,
but not the state.
Mr. Ball motioned to deny installation of a FAST system to increase the gallons
per day to allow for a three-bedroom house. Mr. Santos seconded the motion.
Motion to deny passed.
