1
WITC SHELLFISH GRANT HEARING PAGE 4
5/18/77 '
a reality, that private residents would have access to a few buckets .
I
of shellfish with the permission of the WITC.
V. POCKNETT: I don't think there is anything wrong with it myself.
That' s my opinion. Will this be open to everybody else?
G. BENWAY: No. f
t W. HURLBURT: Will the passageway between Gooseberry Island and
Punkhorn Point remain open to the public to use? '
R ` V. POCKNETT: Of course. That' s a dead area as far as shellfish
is concerned. Maybe oysters.
MR. NELSON:. That' s a good place for blue crabs.
pF, V. POCKNETT: We want them all out of there. They damage the .
shellfish.
MR. NELSON: That wouldn' t eliminate the crabbing then?
V. POCKNETT: I don' t think so. Anybody can crab the whole area.
R. COURTEMANCHE: There are stiff fines if anyone is found
y i
4 trespassing on a grant. Usually the fines are triple indemnity
three times as much as a normal violation. You would have to seek
permission. from the Council. to blue crab there because you are
raking: the .bott6m.which is illegal- according._to the_.regulations._:.
` Grant doesn' t mean anyone owns anything there using a space of
water to raise shellfish.' The shellfish belong to the Council.
Cud It' s against the law to take shellfish without permission from
the Council.
G
SELMN. MAXIM: Crabs are shellfish. I'm sure if we felt as though
Council should make a concession, we can write anaddendum for crabs,
air as shellfish.
C. COURTEMANCHE: Are the boundaries of this grant going to be below the low water mark or above it?
R. COURTEMANCHE: Low water mark.
kat
D. McCLOUD: The marshland which abuts Gooseberry Island, how
much does the Town own?
R. COURTEMANCHE: There's 50 ' easement to the low water mark.
4 That has changed due to natural erosion.
3
D. McCLOUD: You mean 50 ' from the low water mark back is what
.: the Town owns?
,.
R. COURTEMANCHE: This is what the chart shows.
