McLaughlin, PC. for Kevin Andrade, Trustee of Summerfield Park
Realty Trust.
Jason Streebel explained that a $250 penalty per unit (44 units totaling $11,000) had been assessed
against the units for failure by Stephen McLaughliin to respond to the Assessor's 2014 request for
information concerning the property, including information on rental income and expenses. According to
Mr. Andrade, he had promptly completed the form and returned it to the Assessor's office. Mr. Andrade
added that in accordance with the practice that has been customary for this property for decades, Mr.
Andrade provided the requested information on income and expenses in the aggregate, i.e., for all of the
units as a whole. Bottom line: Not only was Mr. Andrade's response to complete the form never
received, but the required information on income and expenses for each separate unit was not provided.
Mr.Andrade is now requesting that a refund be given in the form of temporary credit to the next quarterly
real estate tax payments due on May 1 2015 as is within the authority of the Board of Assessors. Jason
Streebel recommended that the Board approve an abatement application from Summerfield Park Realty
Trust if received within 30 days of receipt of notice of abatement application request.
