Jim Smith to amend Order of Conditions <br /> Atty_.S_mith: What happened was they went with that Plan A and it was okay and the <br /> idea was to give him enough water so his boat would float. He needs another 13 ft. <br /> The problem stands from the conflicting requirements under paragraph 11 where they <br /> restrict us to a 45 foot pier with a 20 foot float extension to a depth of 2.2 feet. <br /> It turns out from the plan Ahatat the 65 feet mark, the water is substantially below <br /> P. feet. Mr. Bunikis is on vacation and Mr. Kariotis cannot be here. So what they <br /> would like me to do is request another 15 feet to the pier. <br /> Charles: This is Jehu Pond. <br /> Atty. Smith: He would then be in 2 feet of water and his boat would float. As it <br /> is now, he can't bring his boat up to the dock. <br /> Ken: He needs another how many feet? <br /> Atty. Smith: Fifteen. <br /> Ken:- How many docks in there now? <br /> Atty. Smith: You could take one or the other of the two plans there. <br /> Ken: I mean in the whole pond.. <br /> Atty. Smith: I don't know. <br /> Pauline: Fulton has one. <br /> Atty. Smith: He would be the farthest over. <br /> Pauline: DE?E has not superseded our order so I imagine that they are going along with <br /> us. <br /> Ken: What is the disadvantage of putting moorings out there? Why doesn't anybody do <br /> that? <br /> Atty. Smith: This is a temporary dock. He takes it in at the end of the summer. It is <br /> not a permanent one. You people saw fit to grant him that way but what you gave him <br /> really conflicts. You said that this would go out to 2.2 feet and it doesn't. , <br /> Ken: What size boat does he have? <br /> Atty. Smith: I don 't knew -- 26 feet. <br />
