Warwick & Assoc , , Inc . - Agent <br /> This application is to construct and maintain a wood-pile pier, steps , <br /> ramp & float extending Less than 5' into the waters of Jehu .Pond to <br /> serve three lots ) ; clear path to pier at Lots 34t 3 & 36 wheelhouse <br /> Lane - Little Neck Bad`, <br /> Chris Clark, representative for the agent, presented plans . He stated <br /> that the property is owned by New Seabury Corporation, He emphasized <br /> that the Notice of latent specifically included "maintain" . Mr. Clark <br /> stated that he has requested a report from the shellfish warden and the <br /> Harbormaster. A report in the form of a general letter has been re- <br /> ceived from the shellfish warden stating that the concern is for the <br /> shellfish population. The dock will be 5' above m.L.w . as M.L. W . is <br /> at elevation "0" . The dock will be constructed so as to allow adequate <br /> passage for passersby. Mr.. O lark said that he also has a letter from <br /> New Seabury Corporation giving permission for the owners of Lots 34, <br /> 35 & 36 to build this pier* off of what is known as Reserve area #168. <br /> Mr. Rosenberg questioned what appeared to be a mere 21 elevation above <br /> the marsh area. DQE regulations calf. for 51 elevation. The question <br /> arose as to whether this regulation is 51 above mean low water or 5' <br /> above the marsh. Mr. Clank said that they are showing it as ' above <br /> mean low water. Nor. Clark was unsure as to what the regulation specifies , <br /> Mr. Clark stated that he will, of course , follow the regulations and <br /> make any adjustments , if necessary. <br /> A lengthy discussion ensued involving abutters present concerning the <br /> legality of New Seabury Corporation t o allow people to put docks on <br /> their property. Ms . Dardao declared that this was not a matter <br /> appropriate for decision or ruling by the Conservation Commission, <br /> As there were no further questions , comments nor discussion, an Order <br /> f Conditions was written and will be issued upon receipt of a DEQE No. <br /> The following special conditions are a part of that Order of Conditions <br /> 1 . The Petition is Denied without Prejudice because of the need for <br />
