Louise Behrman , Chairman pro tern , Mary <br /> ars l ; Joseph Burns ; Elliot Ros l and Patrick Coffey . <br /> 7 . 00 Wayne Tavares of Heritage Landscaping came before the Commission <br /> concerning the Enforcement order issued to George Regan . A letter from <br /> John Varkonda was read which stated the two paved driveways gust be re- <br /> moved , bank revegetat d and trees must be at least 4 inches In diameter. <br /> The paved driveway has been removed and replaced with stone . There has <br /> been a change that was acceptable to Lisa . <br /> Ms Behrman suggested be go over the changes and the reasons why , <br /> . Tavares stated it is expeditious to not replace like that was cut <br /> with like to be planted ; a 4 inch tree would not survive in that sit- <br /> uation . They propose to plant with not indigenous trees but indigenous <br /> shrubs with root systems that will hold the slope better . <br /> Ms Behrman stated the Commission was looking to replace the shade cover <br /> for the pond and to replace the Beechs to be compatible with adjoining <br /> areas . <br /> Mr. Coffey stated Beech trees would give wild life fodder . He had no <br /> problem with less than 4 inch trees . <br /> It was agreed the trees should be placed at the crest of the bank . <br /> Mr . Rosenberg stated he would accept Mr . Tavares ' s suggestion with the <br /> caveat that once planted the Commission look at it and there be a sur- <br /> vey of the adequacy before there is a sign-off . Th r^e should be a <br /> clear understanding there will be no request for a Certificate o <br /> Compliance until this is completed , it takes for a little while and <br /> then when the Certificate of Compliance is requested , it is kept open . <br /> 1r . Tavares suggested a length of time b specified such as the Nursery- <br /> mens ' <br /> guarantee , usually one growing season . <br /> VOTE : Notion made and seconded that they be allowed to go ahead with <br /> the understanding that when the planting is completed the <br /> Commission will look it over and discuss the adequacy of it <br /> and the time before a Certificate of Compliance will be issued <br /> will be written into the order of Conditions . <br /> ir.. Tavares suggested that it be written that the plants must be main- <br /> tained in a healthful state in perpetuity . <br /> Mr . Rosenberg stated , considering the court situation , this may require <br /> an agreement signed by both parties . <br /> Ms Behrman to check with Town Counsel . µ <br /> As ars aside , Mr . Tavares stated he. hoped the Commissions round get more <br /> "teeth " into the penalty situation in cases like this . He left a copy <br /> of the plan with the Commission . <br />
