Mr. Doherty motioned to accept the minutes of March 6, 1997, Mr. Ball seconded, <br /> all agreed. <br /> UNSCHEDULED P INTMENT- James Bernard- 12 Great River Road <br /> Mr. And Mrs. James Bernard was in attendance to request the Board reconsider <br /> their vote of March 6, 1997 which denied variance relief. <br /> Mr. McQuaid stated, "This matter was before the Board lastweek." "It's an <br /> upgrade from a cesspool septic system to a maximum feasible complying Title v <br /> system." "This upgrade is based on the fact ,that a septic system inspection was done <br /> because the property is on the market for sale." "The cesspools were not in failure it was <br /> just their proximity to Great River was such that it rendered an automatic failure." "Cape <br /> Islands Engineering designed a plan to upgrade to the maximum feasible compliance <br /> however, although.increasing the distance to Great River from the,existing cesspools the <br /> proposed leaching facility would only be 2' from the edge of a retaining wall on Cheat <br /> River." "It was the Board's decision last week to deny the plans and suggest that the <br /> applicant at least consider bringing in a denitrification system." "I have since then been <br /> informed the applicant was informed that we would grant the necessary variances for the <br /> upgrade considering that what was proposed is better than what's existing as long as the <br /> applicant signs the affidavit saying that he or his successor owners would not propose <br /> increasing the square footage of the building." "The applicant is here before us to present <br /> his side of the story." <br />
