I <br /> Board of Selectmen <br /> Regular Meeting <br /> Wednesday, April 22, 1987 <br /> Board Members present : Willard Hanson, Chairman; B. Jean Thomas , <br /> , <br /> Peter Lawrence . Joseph Murphy, Executive Secretary, was also present. <br /> The Chairman convened this meeting at P* M- <br /> r. Murphy noted an exception to the minutes of the Regular Meeting <br /> Of April 15, 1987 that there was no vote taken on the ratter of the <br /> Parks and Recreation Department bid specifications for four-cylinder <br /> pick-up truck. The minutes are amended by deletion of the last sentence <br /> of that raragraph 3 under Old Business , "The motion was passed"' . <br /> Mrs .. Thor as roved to accept the minutes of the Regular Meeting of April <br /> 15, 1987 after amendment and also to accept the minutes of the Executive <br /> Session held on that date . Mr. :Lawrence seconded the motion, The vote <br /> was unanimous . <br /> APPOINTMENTS AND HEARINGS <br /> I* Rotary-a.ry- Liquors of Mashpee dA/a south Cape Liquors . <br /> ■��r�.�.�.r rir���i����i <br /> The Executive secretary advised the Board that Rotary Liquors of <br /> Ias hpe e d/b/a. south Cape Liquors remains closed for business and that <br /> the tempOr' ary period of authorized closure expired March 24p 1987a <br /> . <br /> Mr. Murphy said that the President of Rotary r Liq ors of Marsh.pee has <br /> notified the Office of the Board on March 30, 1987 of the intent to <br /> remain closed, Ir. Bacher was present for this scheduled public <br /> hearing as was his attorney, Robert Mills , to show cause whir the <br /> liquor license should not be revoked. Mr. Murp4y noted that notice <br /> has been given to south Cape Liquors , the Licensing Board and the state <br /> Alcoholic Beverage Control Commission. Ire reviewing this matter, <br /> Mr. Mills commented that it is is belief that at the ..time of the pro- <br /> posed sale of the business , the intended transferee of the Liquor <br /> License e ha.d never filed for corporate status with the Commonwealth, <br /> such filing being an action which would have hastened the s oluti n o <br /> this situation and the violations concerning temporary closure would <br /> not have occurred. Mro Mills stated that the new transferee of the <br /> Iicense will be Fields Point Corporation or a, corporation that Fields <br /> Point will be establishing wie thin the next two w e k , n. be.haT of <br /> his client ,- Mr. bills requested an additional thirty-day extension on <br /> the- license . He noted that there are twelve lienholders and a, pledgee <br /> on the liquor license who would be substantially affected by a re- <br /> vocation of the licenses Mr. Mills said that Fields Point has signed <br /> agreements with all lienhol hers . He also said that the final agree- <br /> vent between South Cape Liquors and Fields Point Corporation should <br /> take place within the next week and suggested that a, transfer hearing <br /> take place within that thirty-day extension. Mr. Storrs , representing <br /> Fields Point Corporation all vendors holding liens against the license <br /> have agreed to accept that Fields Point Corporation will assume the <br /> liabilities of the license . lir* Lawrence roved that the Board of <br /> Selectmen continue this hearing to May 272 1987 at 2: 00 P, M, Mrs . <br /> Thomas seconded and the- vote was unanimous ,, The Chairman closed the <br /> he acing at 7: 15 P M. <br />
