It may be twenty years from now <br /> before it comes into play. <br /> Mr. Santos stated that the only problem that he has is what notification or <br /> what can the BOH require of the homeowner to notify the BOH when they do <br /> sell. For example, the present homeowners sell the house two years from now <br /> and three years from now New Seabury want to put utilities on that side of the <br /> road. Now that new owner is being told to move the septic system. Is there any <br /> obligation to the future owners to notify them of the situation? <br /> Mr. Harrington stated that most of the time new homeowners pull the file and <br /> review the history of the lot. However, there is no guarantee that this will be <br /> done prior to sale and purchase. <br /> Ms. Warden stated that a copy of the written note that Mr. Harrington will send <br /> would be in the file. <br /> Mr. Harrington also stated that he could make a condition that the variance <br /> would be attached to the deed. That way it goes with the property and any <br /> future owner or attorney that looks it should note the variance and buy the <br /> property with knowledge of the situation. <br /> Mr. Santos reiterated that his concern is somebody getting blindsided by this <br /> issue. <br /> Mr. Doherty stated that if the variance being attached to the deed would satisfy <br /> Mr. Santos' concerns it was acceptable to him. His big thing is that he doesn't <br /> appreciate being put in the middle. <br /> Mr. Harrington stated that if the BOH comes to that agreement and the Barr's <br /> themselves dislike that decision. They can take it from there. If they wish to <br /> continue it civilly that is well within their rights to do so. The BOH members <br /> will get to vote on it formally for the next meeting. <br /> APPOINTMENT: Cape & Islands Eng. Stendahl Place <br /> Mr. David Sanicki was present from Cape & Islands to continue a further <br /> discussion of the septic installation at Stendahl Place. He was requesting the <br /> following local upgrade approval: The proposed soil absorption system will be 5' <br /> off the property line. (10' required). We are also requesting approval to install a <br /> Micro-Fast 4.5 denitrification unit. Mr. Sanicki also had the notification for the <br /> sole abutter that was returned to them. He doesn't understand why. <br /> The BOH members and Mr. Sanicki began by reviewing a multitude of <br /> engineered plans. The other individual present was a James F. McCarthy, <br /> Stendahl Condominium association president. <br /> Mr. Sanicki began by stating that this location has been before the Board more <br /> than one year ago with seven individual septic systems consisting of septic <br /> tanks and leaching pits that were in hydraulic failure.
