Maybe with the technical follow-up rather than waiting for repair <br /> to take place pending the Board's meeting? <br /> Mr. Harrington stated that right now the regulations states that the installer <br /> has to seek the variance. <br /> Mr. Ball asked Mr. Harrington if he was trying to skip a step. Instead of it <br /> coming through the BOH that he can just confirm the request. <br /> Mr. Harrington responded that he was not trying to skip any steps. He is just <br /> trying to clarify it so that everyone receives the same treatment. That is <br /> basically what the regulation says right there. <br /> Ms. Warden, again, asked Mr. Harrington if he wanted that technical approval <br /> authority. <br /> Mr. Harrington responded that his belief is that it would save the BOH some <br /> time. These situations are few and far between. But, the question gets posed to <br /> him and he would like to know what the BOH members' opinion is in this <br /> matter. <br /> Mr. Ball responded that the BOH always grant the request. Why not give Mr. <br /> Harrington the authority to do it. Why should it have to come in front of the <br /> BOH members? That is what he meant by "skipping that step" coming in front <br /> of the BOH. <br /> Mr. Doherty then asked, "What grant the variance under 1507' Did Mr. <br /> Harrington want the BOH members to say that if the request is between 100 <br /> and 150' then the agent can authorize it? Mr. Doherty said that that was fine. <br /> He had no problem with it. So long as he brings it to the BOH members <br /> attention after it. <br /> Mr. Harrington then asked if it needed to be in variance form. <br /> Mr. Ball then asked how Mr. Harrington felt about it. He wanted to make it <br /> easier for him. <br /> Mr. Doherty stated that it needed to be a variance if it is under 150'. As far as <br /> he is concerned that is pretty clear cut and dry black and white. The Town <br /> regulations are 150' and anything less than that it needs to be a variance. If it <br /> is over 100' and still under 150' are we going to grant that variance? <br /> Absolutely, they always do. That's where, obviously, where the 150' wasn't <br /> obtainable. There are a lot of lots in Town where it is impossible to do. The <br /> BOH's intent was to condemn those lots. They were just trying to get greater <br /> linear distance on future development where the lots where bigger. The Town <br /> went from postage stamp parcels to 2-acre zoning. <br /> Ms. Warden then asked Mr. Doherty if the health agents could just bring the <br />
