It <br /> would validate any perk tests and/or soil evaluation longevity from 1995 forward. <br /> Mr. Ball asked if they needed a motion to accept the 1995 soil regulations. <br /> Mr. Harrington replied that he would write up the change in policy request. <br /> However, he would like the BOH member's approval to begin the change in policy <br /> on a verbal basis until such time as he has it in a written format. <br /> Ms. Warden stated that the BOH is going to amend the current policy from three <br /> years and extend it from 1995 forward. <br /> Mr. Ball stated that that language was in fact correct. <br /> Mr. Harrington stated that there are applicants that it would directly affect right <br /> now. <br /> Mr. Ball made a motion to amend the current policy from three years and extend it <br /> from 1995 forward based on the 1995 soil regulations. Mr. Santos seconded it. <br /> Motion passed. <br /> APPOINTMENT: Beth Barr 307 Shore Drive <br /> Mr. Harrington began by stating that the BOH has discussed this property a <br /> couple of times on an informal basis. The current problem is based on the fact that <br /> an emergency repair was completed on this property. However, it was later <br /> discovered that the leaching portion of the septic system was placed off the <br /> property line. The Board, on two other occasions, reviewed this request prior to the <br /> current informal discussions. The first time the BOH reviewed it information was <br /> brought to light that there was potential ownership to the middle of the private <br /> way. This information has since been found to be incorrect. The property line is the <br /> actual property line. The BOH needs to determine what the final outcome will be at <br /> the applicant's request. Mrs. Barr has stated before that she would like to know if <br /> the leaching field should be moved or not. The Board, on two other occasions, did <br /> not agree with the request to move the leaching field. <br /> At this point Mrs. Barr asked if she could add her point of view to the proceedings. <br /> Mrs Beth Barr then introduced herself. She continued by stating that they had <br /> originally thought that the leaching field was 10' off of her property. It is actually <br /> 15' off of their property. When they originally purchased this cottage they went <br /> through the appropriate Title V testing requirements and it passed. They had <br /> hoped to demolish the cottage because it is very old and in terrible condition. Then <br /> they had the survey done and found out that the septic system was not on their <br /> property. They went through the whole rigmarole with New Seabury and the BOH <br /> wondering how something like this could happen in this day and age. It was an <br /> emergency repair. They've hired a lawyer only to find out that Title V is Title V <br /> whether it is an emergency repair or not. This system was just "plopped" down in <br /> the roadway/walkway that goes up to Popponessett Marketplace. Their issue is <br /> that they would like to put some considerable money into the property. In so doing <br /> when they go to sell it, maybe five-years from now, the lawyer has advised them <br />
