3 <br /> times. <br /> 6 Bioterrorism Preparedness Seminar for BOH: <br /> Mr. Harrington stated that this was, again, an FYI item. <br /> Mr. Ball asked if Mr. Harrington was going to attend this seminar. <br /> Mr. Harrington replied that he would be attending this seminar. <br /> Mr. Santos asked if there had been any instances of anthrax to date. <br /> Mr. Harrington replied that there had been three responses to the anthrax scare. <br /> However, all of the results have been negative in the initial anthrax bacteria <br /> testing. They have not gone through the full testing criteria. <br /> 7. Mashpee Mart Tobacco Sales Permit: <br /> Mr. Harrington stated that retail inspection was done. This facility was formerly <br /> Chaudhry's on route 28. The retail inspection was fine. They just need the Board's <br /> approval for the tobacco sales permit. <br /> Ms. Warden stated that it was under new management. It is next to Honeydew. Ms. <br /> Warden believed that the previous owners might have been cited for tobacco sales <br /> to minors. But they haven't been in the last few years. <br /> Mr. Ball made a motion to approve the request for a tobacco sales permit. Mr. <br /> Santos seconded the motion. Motion passed. <br /> Mr. Ball then inquired as to whether or not that this store would start with a clean <br /> slate in regards to selling to minors. <br /> Mr. Harrington responded that they would in fact begin with a clean slate. <br /> DISCUSSION: <br /> B. Perk Test/Soil Evaluation Loneevity <br /> In the interest of time, Mr. Harrington suggested that they discuss the "perk <br /> test/evaluation longevity" topic rather than the "testing of seasonal I/A systems" <br /> which was topic "A" on the agenda. Mr. Harrington continued by stating that there <br /> is a verbal policy in place regarding how long the perk test and test hole <br /> information is good for which at present is three years. He would like to amend the <br /> current policy by including all testing done from 1995 forward. He is basing this <br /> request on the 1995 change in the soil regulations. Furthermore, this includes the <br /> ability to use "mottling" and Trimpters". This would change the expiration from the <br /> three years back to 1995 to date and continuing. <br /> Ms. Warden continued that the Town of Mashpee is the only town left on the Cape <br /> that has the three-year statute of limitation and not the 1995 regulations. <br /> Mr. Ball asked what this decision would do to the three-year regulation. <br />
