It could be moved within that setback. However, a notification to New <br /> Seabury would need to be made to do that. <br /> Now that the BOH has been notified that the property is going to be further <br /> developed as far as the existing cottage to be razed and a new building to be <br /> constructed. Mr. Harrington had the following recommendation for the present and <br /> any potential new owners. He would recommend that a compliant leaching and <br /> reserve area be made available if they wish to increase the size of the dwelling. <br /> Mr. Ball then asked the current homeowner if this was their intent. <br /> Mrs. Barr stated that they had no intention of increasing the dwelling. The system <br /> that exists is fine for their plans. It is a three-bedroom system. However, they have <br /> been advised that they cannot go forward. They have also been advised that if they <br /> don't resolve this issue it will just continue into the future. This issue has gone on <br /> for two years as to who owns the road and the path, New Seabury or Maushop <br /> Village. The bottom line is that the system is not on their property. <br /> Mr. Harrington then stated that he wasn't sure how the deed or title search comes <br /> into play as far as the property-transfer. But, on the septic system inspection there <br /> is no failure criteria for setbacks. If the leaching is off of the property there is no <br /> criteria that would force it to be moved. If the property were to be sold in Title V <br /> there is no failure criteria to force them to move it. <br /> Mr. Ball then asked if this system was completed in 1998? He then asked if anyone <br /> checked the measurements on this as built. <br /> Mr. Harrington responded by stating that Chris Costa did the work and he is the <br /> land surveyor. However, he didn't have the actual stamped copy. <br /> Ms. Warden asked if the as built was done after the fact. <br /> Mr. Ball responded that the as built was done in 1998. <br /> Ms. Warden asked if there was a plan from Mr. Costa for the upgrade. <br /> Mr. Harrington clarified that the as built was not completed by Mr. Costa. Mr. <br /> Bortolotti did the work and the as built. Mr. Costa surveyed the property and <br /> completed the sketch after the fact. Mrs. Barr hired Mr. Costa to do the survey. <br /> Mr. Ball then did some measurement calculations regarding the location of the <br /> leaching facility. <br /> Ms. Warden asked what the topography was at the back of the lot. And why the <br /> system wasn't put in that particular area. <br />
