They also had Orin Evans present. But, <br /> according to her attorney on a failed system is a failed system and it should have <br /> been surveyed. You don't just "plop" in a system and hope for the best if the Town <br /> is regulated by Title V. <br /> Mr. Santos asked if Bob Bortolotti was willing to go back and move the system. <br /> Mr. Harrington stated that Mr. Bortolotti was willing to do whatever the BOH <br /> members want. <br /> Mr. Ball asked Mr. Harrington to give him one recommendation. <br /> Mr. Harrington stated that the system was out of compliance, which was the <br /> bottom line. He recommended that they get it back on the property anyway. <br /> Mr. Ball asked if it was not going to be at the Town's expense. <br /> Mr. Harrington replied that the BOH could work something out with the other <br /> parties involved. That would be fine. He believed that that was the right thing to do <br /> because it is out of compliance. The BOH department had several hands in letting <br /> it fall where it did. Therefore, if the BOH wants to figure a percentage of blame <br /> and/or cost then that's fine too. <br /> He continued by stating that he wanted to reiterate John Doherty's, the chairman, <br /> opinion in this matter, which is in the minutes. Mr. Doherty wasn't in favor of <br /> being the heavy in this matter as far as forcing someone to correct this situation. <br /> The chairman's objection was that installation of the system was done under the <br /> BOH's emergency repair guidelines. There was someone of limited means living in <br /> the house and the BOH was doing everything they could to help the citizen at that <br /> point in time. He believes that was Mr. Doherty's stance on the matter. <br />
