9
sell this property now and they knew that this septic system was not on their
property and didn't disclose this information they could be in big trouble. The point
is that if they could rectify this and Mr. Bortolotti could move this system then that
would be great. They wouldn't have to go any further with the matter.
Ms. Warden stated that there is a letter in the file from Mr. Bortolotti stating that
he will complete this task with the BOH directive.
Mr. Santos stated that he was in complete agreement with the recommendation to
get the system back on the property. It had gone on for too long.
Mr. Ball made a motion to contact Mr. Bortolotti to direct to him to move the
system back on the property at no expense to the Town.
Mr. Santos asked if they wanted to include any needed variances.
Mr. Ball recommended that they leave the variance issue up to the agent.
Mr. Harrington stated that there would be a new construction permit and a new
proposal. They will review the proposal, grant the variance and notify New Seabury
as the owner of the right-of-way at that point.
Mr. Santos seconded the motion to move the system only. Mr. Pesce began by stating
that he and Mr. Harrington had had several discussions regarding this particular
site. Mr. Pesce stated the owner, Mr. Smith, has an
Order of Conditions, put a hay bale fence line and has cleared the lot land ward of
that line in anticipation of the BOH allowing the permit to proceed.
He wanted to state for the record what the changes were from the past plans. The
footprint and position of the home have not changed.
Mr. Harrington asked if the latest revision of 09.08.01 were correct?
Mr. Pesce confirmed that they were the correct plans. The big picture situation is
that they are still looking at a "Clivus Composting Toilet" for black water and a gray
water leaching system consisting of a 1500-gallon tank and a conventional
leaching system sized appropriately 60% for just the gray water leaching. It is a
very tight lot, as everyone well knows. Both conservation and the zoning board
understand the trade-off here. The zoning board approved the front setback. There
is no movement of the footprint towards or away from the wetlands. What is
different is that the foundation has come up a little higher to allow a larger and
more compliant separation from groundwater. He is asking for fewer variances
from the earlier time. They have provided a reserve area whereas before, pretty
much from discussions with the previous health agent, Elias McQuaid. They just
had a big footprint of a leaching field with the knowledge that they would have
