10 <br /> some excavation to do when the time came. It is some of the same setback <br /> variances. There is one less since he has a 10' separation from the front lot line. It <br /> is the same variance and same distance from the setback from the edge of the salt <br /> marsh for the leaching system. The final variance from the Town of Mashpee bylaw <br /> for less than 2' of naturally occurring permeable soil between the bottom of the <br /> S.A.S. and groundwater. They did perform a deepwater perk to demonstrate that <br /> the soil was there. He was aware of the controversy over that whole effort. He <br /> wanted Mr. Harrington to comment on anything further that he might have <br /> missed. <br /> Mr. Harrington wanted to bring a couple of items to the BOH members' attention. <br /> He reiterated that they were requesting a variance from the Town of Mashpee for <br /> less than a 100' separation from the S.A.S. to the edge of the salt marsh (75.1' feet <br /> shown.) Mr. Harrington was wondering what they should do about the wetlands <br /> across the street at 61.8' away. At less than 75' the BOH requires UV disinfection. <br /> The Town has a local bylaw that is a black water gray water regulation which <br /> requires that if you are going to use the black water gray water or Clivus <br /> Composting Toilet you have to have at least 4' of naturally occurring pervious <br /> material above the groundwater. That is not the case here. There is also an <br /> exception in that same regulation that if you don't have the 4' you can go down to <br /> the 2' and in this case you don't even have the 2' of naturally occurring. They had <br /> to go down into groundwater to obtain naturally occurring pervious material. Also, <br /> this is a mounded system. He wanted to make sure that the BOH is aware of the <br /> items that were being presented before them. <br /> Mr. Pesce responded to the UV disinfection. He would argue against that because <br /> he has in the past been before the BOH where they have required him to put a UV <br /> disinfection system in for a conventional septic system on Surf Drive not too far <br /> away from this location. But, that was for a conventional septic system. It was only <br /> a black water source that most of the viruses and pathogens would be generated <br /> from are not going to be transmitted into the groundwater system. He would then <br /> argue that that is not the same condition and ask for the BOH's understanding in <br /> that regard. The other issues are issues that he and Mr. Harrington have talked <br /> about. He completely agrees and understands. Mr. Harrington felt that it was <br /> important for them to be before the BOH tonight to make sure that all of the <br /> discussion is complete and the file is complete. The BOH had approved it before. <br /> They then went down the road with the BOH's concurrence to the other two Boards <br /> in Town. They are basically just trying to button it up this time. <br /> Mr. Ball then asked how high the foundation was going to be. <br /> Mr. Pesce replied that the first finished floor would be above the 100-year flood <br /> plain. But the top of the foundation would be 1 P above sea level. What they are <br /> doing is getting the first finished floor elevation out of the flood plain so that the <br /> construction can be conventional above that surface. <br /> Ms. Warden recommended that BOH have the homeowner file the maintenance <br /> contract with the registry of deeds so that it goes into perpetuity. <br />
