The building inspector is <br /> requesting that the BOH and Conservation departments continue any variances <br /> and/or amended orders until Mr. Kerrigan relinquishes the violations that were <br /> done the building department. <br /> Mr. Ball asked if Mr. Kerrigan had corrected those violations. <br /> Mr. Harrington stated that Mr. Kerrigan brought those violations to the state <br /> Public Safety Board who in turn basically dismissed them. <br /> Mr. Ball then asked for what reason. <br /> Mr. Harrington replied that they did not provide a reason. They stated that they <br /> would put it in the file. Mr. Wheeler, building inspector, took it as far he could <br /> and he basically lost. Mr. Harrington wasn't sure if it was a case of who you <br /> know. Mr. Wheeler went as far as he could with it. Mr. Harrington reiterated <br /> that there were health regulations that they had to follow and enforce. That was <br /> what he was trying to accomplish. But, there are a couple of ways to go about, <br /> which is why he was asking their opinion. <br /> Mr. Ball reiterated that that is why he was asking these different questions <br /> because he wanted to make sure that he was covering all of the bases. The <br /> engineer signing off doesn't provide the homeowner with the right to go forward <br /> with the compliance and occupancy permits. <br /> Mr. Harrington reiterated that it was a Title V requirement that both the <br /> installer and engineer have to sign off. <br /> Mr. Santos asked if Mr. Wheeler was waiting for the BOH to sign off. <br /> Mr. Harrington stated that Mr. Wheeler wasn't waiting for anything. He has gone <br /> as far as he can. The building issues have been taken care of to the best of his <br /> knowledge. <br /> (There was a secondary conversation going on at the same time between Ms. <br /> Warden and Mr. Ball) <br /> Ms. Warden stated to Mr. Ball that the issues between the installer and the <br /> homeowner are none of the BOH's business. It is a civil matter between those <br /> two parties. <br /> Mr. Ball felt that it was none of our business. But, he also felt that the two <br /> parties were using the BOH. <br /> Ms. Warden replied that the homeowner should pay the installer and pursue it <br /> in court. The homeowner shouldn't just try to skip by the whole issue. <br />
