This would result in the BOH matter never <br /> being settled, which allows the property to continue to be illegally occupied. <br /> Mr. Ball's opinion was that whatever Mr. Harrington recommended was fine with <br /> him. <br /> Mr. Harrington continued that he was going to issue the letter and go after Mr. <br /> Kerrigan and fine him. Mr. Kerrigan, on at least two occasions he has requested <br /> to appointments before the BOH and not shown up. Mr. Harrington feels that <br /> Mr. Kerrigan is playing the waiting game. Mr. Kerrigan has never been issued an <br /> order letter to provide the certificate of compliance or putting some other <br /> pressure on Mr. Michael LaBute, the installer, to issue the installer's certificate. <br /> Mr. Santos asked if he the other letters sent to Mr. Kerrigan were sent by <br /> certified mail. <br /> Mr. Harrington confirmed that they have been sent certified mail and Mr. <br /> Kerrigan has collected it. <br /> Mr. Santos does not look at it as the BOH being in the middle. It is an issue <br /> between those two parties. <br /> Mr. Harrington interjected that Mr. Kerrigan already brought this before the <br /> BOH and denied his request. The money right now is over landscaping. Mr. <br /> LaBute stated that he has been paid for the septic installation. The variance <br /> before the BOH in June was for him to get occupancy without supplying the as <br /> built. The BOH denied that because the installer is still in town. That variance <br /> would be provided if the installer had moved out of town or was no longer in <br /> business. There was a reason why the BOH denied the request at that time. <br /> Mr. Ball wanted to confirm that Mr. LaBute was paid for the installation for the <br /> installation of the septic system. <br /> Mr. Harrington confirmed that Mr. LaBute was paid for the installation before <br /> the June BOH hearing. It doesn't matter what the monetary value or civil matter <br /> is at this point in time. It is a matter of not having an as built card. <br /> Mr. Ball asked why the BOH couldn't order the installer submit the as built <br /> within seven days. <br /> Mr. Harrington replied that there is no time line for the installer to submit the as <br /> built cards that he could uncover in the regulations. <br /> Mr. Jack Landers-Cauley then interjected the following suggestion. He stated <br /> that some towns treat this type of issue differently. They say that the engineers <br />
