Mr. Kerrigan has been given more than enough <br /> opportunities and failed to even provide an excuse as to why he hasn't shown up <br /> for his appointments. <br /> Mr. Ball agreed with Mr. Santos. He also wanted to state for the record that he <br /> didn't like to be held up by the installer. There has got to be other ways to <br /> achieve the BOH's goal without being put in the middle. <br /> Mr. Ball continued by hypothesizing if both the health agent and the engineer <br /> went out to review the system and came to an agreement that it was installed <br /> correctly and in accordance with Title V regulations. Would that be enough? <br /> Mr. Harrington replied that it would not be enough for Title V. <br /> Ms. Warden interjected that that was asking an awful lot. <br /> Mr. Ball stated that it should be a case by case situation. These situations only <br /> come up once and awhile. <br /> Mr. Harrington stated that Ms. Warden looked at this system. Then the system <br /> was back filled. The installer and the engineer looked at it. But, the as built has <br /> not been completed. <br /> Mr. Santos asked what the standard fine would be for Title V. <br /> Mr. Harrington responded that the standard fine is no less than $10.00 and no <br /> more than $500.00. His experience has been that it has been no less than <br /> $40.00 per day. <br /> Mr. Ball made a motion to accept Mr. Harrington's recommendation to fine Mr. <br /> Kerrigan of 14 Oneida Avenue $40.00 per day for failure to comply with Title V <br /> Certification of Occupancy requirement. Mr. Santos seconded it. Motion passed. <br /> Mr. Ball asked to place this topic back under the "new business" topic. He <br /> wanted to review our policy so that it doesn't happen again. <br /> B. Tobacco Regulation <br /> Mr. Harrington began by stating that he placed this topic on the agenda for the <br /> BOH members' feelings regarding the re-working of the potential ban as the new <br /> smoking regulations are revisited again. Some of the local citizens have <br /> requested to be on the December 13th, 2001, agenda. They are being supported <br /> by the American Cancer Society. He would like to pass on to them the BOH <br /> members' feelings regarding the ban or form they would entertain regarding a <br />
