Furthermore, it was an assumption on <br /> his part, but Conservation may have contacted the County in an effort to obtain <br /> guidance from them as to the best method to achieve their goals in this particular <br /> situation. <br /> Ms. Warden then interrupted the conversation stating that she left a very <br /> important issue out. The Town is currently taking Mr. Sheehan to court. He is <br /> living in the house without an occupancy permit. Furthermore, he has done a lot of <br /> the work himself. Russ Wheeler, building inspector, was working with the BOH to <br /> ensure that all the regulations have been met because he is taking Mr. Sheehan to <br /> court. But, Mr. Sherman from the Conservation Commission along with Russ <br /> Wheeler had informed Mr. Sheehan that they had previously required that he <br /> install three monitoring wells within the location of the leaching facility. Mr. <br /> Sheehan had not complied with this request. The case will be heard in one week <br /> before a judge in court. <br /> Mr. Doherty stated that the whole issue of Conservation having jurisdiction in <br /> surface water bodies is something that BOH has gone round and round on. <br /> Conservation would make requirements in excess of what BOH requires. This <br /> causes the BOH to ask them "what are you doing in the septic business?"We will <br /> agree not to step in your backyard if you won't step in our background. <br /> Conservation has been pushing for many years for more power. There is a definite <br /> inherent overlap that in turn causes a definite conflict. However, Mr. Doherty had <br /> to say "Shame on Dennis. He should know better." <br /> Ms. Warden stated that Mr. Scannell does know better. He had been in to apologize <br /> and wasn't aware that the monitoring wells needed permits. Mr. Scannell hasn't <br /> put in a lot of monitoring wells. <br /> Mr. Doherty went on to say that Mr. Scannell was a reputable person. There has <br /> never been a problem. Mr. Doherty said that he was sure it was an oversight, but, <br /> unacceptable none the less. <br /> Ms. Warden said that Mr. Scannell has been in twice. The last time he asked if it <br /> was okay to put in the monitoring wells. She asked him if he had been to see Mr. <br /> Sherman to obtain the protocol. Mr. Scannell responded that he had not. Ms. <br /> Warden then spoke to Mr. Sherman today. He asked if she had seen Mr. Scannell. <br /> Ms. Warden said no. However, he would be in contact with him because there is a <br /> definite procedure.The only thing Mr. Scannell had showed her was a map with a <br /> lot with three circles and writing stating"well, well, well." <br /> Mr. Doherty then stated that a couple of things came to mind. First of all, there is <br /> a perception or an appearance of conflict. However, since the BOH was working <br /> under a severe shortage of staff, having Ms. Warden respond to the complaint <br /> could not have been avoided. Secondly, there are many contradictions between her <br /> account and the letter. This is typical of a complaint letter. The BOH members <br /> have read the letter and heard Ms. Warden's version. He is satisfied with her <br />
