16 <br /> appointment. Ms. Vallas told Ms. Warden that she was very confused that day and <br /> it was an accident. However, that was the second incident of her doing this. <br /> Mr. Doherty asked if the BOH had a previous violation? <br /> Ms. Warden responded that at the time of the initial incident, the transfer station <br /> contractor gave her the trash that was found in the bin. She felt that this was not a <br /> health matter. Ms. Warden stated that in the transfer station regulation it states, <br /> "Any violation of the transfer station regulations will result in a fine." Furthermore, <br /> the Board of Selectmen took over the transfer station. Therefore, they should be <br /> the ones to cite the individual who violated the regulations. In speaking with a few <br /> of the Selectmen, they felt it was a BOH matter. Ms. Steifel felt that it was a BOH <br /> matter. Subsequently, Ms. Warden cited the individual. <br /> Mr. Doherty stated that although the BOH divested themselves of the operational <br /> responsibilities of the transfer station. It is still a town facility and the BOH is still <br /> a town agency. <br /> Mr. Ball didn't know why the BOH members were arguing about this matter. He <br /> felt that it was still the BOH call and will always be the BOH's call. <br /> Mr. Doherty stated that it definitely within the BOH jurisdiction. It is whether or <br /> not they want to proceed with it or handing it off to someone else. <br /> Mr. Harrington's initial comment regarding this was that it was a really hefty fine. <br /> Mr. Doherty stated that the $300.00 was standard for the Town. He doesn't have a <br /> lot of tolerance for illegal dumping. <br /> Ms. Warden then stated that she originally had the evidence from the first incident. <br /> But, she gave the evidence to the Board of Selectmen stated that they would <br /> handle it. <br /> Mr. Doherty reiterated that he would really like the health agents to document <br /> these types of incidents in a systematic manner much like a police report. This is <br /> in an effort to make sure that the BOH has covered all of the bases in case it is <br /> brought to trial. It needs to factual and chronological. He also stated that the BOH <br /> options are limited. <br /> Mr. Ball disagreed and stated that the Board of Selectmen has been billed for the <br /> clean up of the Salvation Army box. He felt that the BOH should get a hold of the <br /> contractor and find out the dates that it happened. <br /> Mr. Doherty continued that the BOH should get a copy of that bill. If the fine <br /> doesn't cover the cost of the cleanup, it should be discussed with the Board of <br /> Selectmen regarding recovery options. <br /> Ms. Warden stated that since she is a no-show and the deadline for payment has <br /> passed. The next option is to pursue this in court. <br />
