15
that says there could be a problem in this area for nitrate loading problems. Tom
Fudala of the Planning Board stated that if that is the case then he needed to do all
kinds of testing for nine-lots and a"maybe". His engineer, Nick Laney, from HML
Associates in Hingham, who did the approval work, stated that they probably
would beat it under the criteria if they did the$30,000.00 worth of testing. But,
there was a delay in the approval and it was only nine lots. He thought
environmentally it would cost him another$5000.00 per house to install the
denitrification systems.
Mr. Ball as him if he was asking the BOH to give him permission to have "general
use"testing.
Mr. DeDecko agreed. He also stated that any alternative systems have to be
approved by the BOH not by the agent along with the modification of the original
septic plans.
Mr. Doherty and Mr. Ball agreed that they had no problem with his request.
Mr. Harrington wanted to clarify all of this because they are not in the Zone and
they are not requesting any other of the advantages of having the denitrification
system.
Mr. DeDecko stated that the Planning Board is requiring him to put the
denitrification systems under their "covenant and conditions'. Who's asking for the
testing? He assumed the testing was done under an agreement that Micro-fast has
with the State. He has to sign the contract with Microfast for the maintenance. He
has to allow them to do the testing.
Mr. Harrington then stated that through general use approval there is no testing
allowed. The BOH would verify that for him. The State has all of the technologies
approval letters on the web.
Mr. DeDecko stated that if he needed to test he would test.
Mr. Ball suggested that rather than hold everyone up. He recommended that the
BOH approve it subject to the results of the research.
Mr. Doherty entertained a motion to approve the plans submitted subject to testing
requirements from the DEP. Mr. Ball seconded it. Motion passed.
Mr. DeDecko submitted two plans for this particular lot. He will be submitting
further plans on the other lots.
OLD BUSINESS
Joyce Vallas re: Illegal Dumping at the Transfer Station
Ms. Warden stated that they received a notice that someone was dumping garbage
in the Salvation Army bins. There was enough mail included in the garbage that
the BOH was able to determine who the violator was. The BOH cited her. She came
into the office and asked to appear before the BOH. Ms. Warden gave her an
