• 5
the Board of Health was located. Ms. Warden stated that she was the Board of
Health. She proceeded to let her know about her chief complaint. She also let Ms.
Warden know that if any person made a complaint pertaining to the farm. She
knows that Ms. Warden has called Mrs. Murphy and forewarned her. Therefore, by
the time someone goes out to investigate the problem. It has been masked. It can
be masked. But, it can only be masked because it never really is corrected. She
stated that she told her "Boni, I don't appreciate you doing that." Last year when
she issued a complaint. The very next day, Mr. Murphy, the husband, came over to
her from the driveway and asked if she complained to the BOH in regards to his
property. She confirmed that she did. He said that he would appreciate if she
would tell him instead of going to BOH. She respected that wish. She will always
let him know first. Ms. Warden stated that she never did that. Mrs. Herrera stated
that "I beg your pardon, I know for a fact that you did. I almost got it from the
horses mouth and I don't mean Mr. Ed." She then asked when there will be a
meeting and whom can she speak to above her. Ms. Warden stated that there is no
one to speak above her here right now. Mrs. Herrera asked when the next meeting
was. Ms. Warden responded that it was October 4t". Mrs. Herrera stated that she
would be there. Ms. Warden replied that Mrs. Herrera could not attend a meeting
without writing a letter and then she would have to issue a letter back stating what
time she should be there. Mrs. Herrera never received a letter back stating when
she should be here today.
Mr. Ball asked her if she wrote a letter to be here today.
Mrs. Herrera stated that she was going to be here anywise.
Mr. Doherty interjected that she could always come because it is an open meeting.
Mr. Scott Proverb then began his personal account of his experience with Mr. and
Mrs. Murphy. He lives at 11 Warwick Way. He is also an abutter. He has lived
there for approximately 11 or 12 years. When he first moved in Katherine Lapio
owned the farm. It was a completely different situation. No one had any problems
with the bam. They are not anti-horse people. When he was looking at the house to
buy he thought it was a great thing to have across the street rather than houses
across the street. He checked in with the neighbors. Everybody said that they
never had any problem with it. They moved in and never had a problem with flies,
smell or nothing at the time that Katherine owned the farm. It was so good, in fact,
that he went to bat for Katherine, and unfortunately hindsight is everything. He
went to the meeting to back her up on the variance of the barn. Little did he know
that she wanted to get the variance cleared so she could sell the property? He feels
like an idiot now. But, regardless, the property has been sold as least a couple of
years ago.
When the new owners moved in it was a situation where there were problems right
away. They new owners did say that if there was a problem please come and see
them. He might have jumped over their heads and directly called the BOH rather
than bringing the issues up to the owners. That was a mistake because it has
almost come to fist-a-cuffs several times with himself out in the middle of the
street. It was an ugly situation. The thing that brought to a head was the fact that
