ADDENDUM TO OWNER-CONTRACTOR AGREENIENT <br /> BETWEEN <br /> TOWN OF MASHPEE (Owner) <br /> And <br /> STATEWIDE ENGINEERING& CONSTRUCTION CO., INC: (Contractor) <br /> For THE MASHPEE SENIOR CENTER(the Project) <br /> The Owner and Contractor acknowledge and agree that 1) the Town's Board of <br /> Selectmen voted to award the contract for the Project to the Contractor on November 3, <br /> 2003 and 2) the execution of the owner—contractor agreement for the Project and the <br /> Town's issuance to the Contractor of a notice to proceed could not take place until the <br /> Town received approval to enter into the agreement from the Massachusetts Department <br /> of Housing and Community Development (DHCD), in accordance with a condition of <br /> DHCD's grant to the Town for Project funding. DHCD notified the Town of its approval <br /> on or about December 15, 2003. As a result, commencement of the Project work will <br /> take place later than might have been anticipated, and during a time when winter weather <br /> conditions may exist. <br /> Notwithstanding the provisions of Article 8 of the General Conditions, the Owner and <br /> Contractor agree that certain work activities that might have commenced prior to the <br /> onset of winter weather conditions may be more difficult to perform, or may not <br /> reasonably be performed, during the existence of winter weather conditions; and agree <br /> that additional time that may be needed for the performance of those activities could <br /> affect the scheduling and performance of other work activities and the achievement of <br /> substantial completion within the designated 270 day period following issuance of the <br /> notice to proceed. Therefore, the Owner and Contractor agree that the impact of winter <br /> weather conditions on the performance of work according to the Contractor's approved <br /> progress schedule shall be reviewed during each weekly meeting for the purpose of <br /> determining whether an extension of time is warranted. If the Contractor believes that <br /> winter weather has had an impact on the performance of work according to the approved <br /> progress schedule, it shall present such information and data as will enable the Architect <br /> to determine the extent of the impact and the propriety of the time extension requested. <br /> Any extension of time authorized under the provisions of this Addendum shall not take <br /> effect until the original 270 day period and any other extension granted to the Contractor <br /> have expired. Any extension of time authorized hereunder shall not alter the Contractor's <br /> obligation under Paragraph 8.2 of the General Conditions to proceed with the work of the <br /> Project expeditiously with adequate forces. <br /> If the Architect does not approve a time extension hereunder as requested by the <br /> Contractor, the Contractor may make a formal claim for additional time in accordance <br /> with Article 4 of the General Conditions. <br />
