ADDENDUM TO OWNER-CONTRACTOR AGREENIENT BETWEEN TOWN OF MASHPEE (Owner) And STATEWIDE ENGINEERING& CONSTRUCTION CO., INC: (Contractor) For THE MASHPEE SENIOR CENTER(the Project) The Owner and Contractor acknowledge and agree that 1) the Town's Board of Selectmen voted to award the contract for the Project to the Contractor on November 3, 2003 and 2) the execution of the owner—contractor agreement for the Project and the Town's issuance to the Contractor of a notice to proceed could not take place until the Town received approval to enter into the agreement from the Massachusetts Department of Housing and Community Development (DHCD), in accordance with a condition of DHCD's grant to the Town for Project funding. DHCD notified the Town of its approval on or about December 15, 2003. As a result, commencement of the Project work will take place later than might have been anticipated, and during a time when winter weather conditions may exist. Notwithstanding the provisions of Article 8 of the General Conditions, the Owner and Contractor agree that certain work activities that might have commenced prior to the onset of winter weather conditions may be more difficult to perform, or may not reasonably be performed, during the existence of winter weather conditions; and agree that additional time that may be needed for the performance of those activities could affect the scheduling and performance of other work activities and the achievement of substantial completion within the designated 270 day period following issuance of the notice to proceed. Therefore, the Owner and Contractor agree that the impact of winter weather conditions on the performance of work according to the Contractor's approved progress schedule shall be reviewed during each weekly meeting for the purpose of determining whether an extension of time is warranted. If the Contractor believes that winter weather has had an impact on the performance of work according to the approved progress schedule, it shall present such information and data as will enable the Architect to determine the extent of the impact and the propriety of the time extension requested. Any extension of time authorized under the provisions of this Addendum shall not take effect until the original 270 day period and any other extension granted to the Contractor have expired. Any extension of time authorized hereunder shall not alter the Contractor's obligation under Paragraph 8.2 of the General Conditions to proceed with the work of the Project expeditiously with adequate forces. If the Architect does not approve a time extension hereunder as requested by the Contractor, the Contractor may make a formal claim for additional time in accordance with Article 4 of the General Conditions.
