Town Manager Tom Mayo <br /> From:Town Planner Tom Fudala <br /> CC: Jason Streebel <br /> Date: 7-18-12 <br /> Re: Zoning at 117 Industrial Drive Extension <br /> Per your request,the following regards the applicable zoning on the above lot: <br /> The 115,994 sq. ft. lot (2.66 acres) is primarily located in an 1-1 Industrial zoning <br /> district. A 100 foot wide strip at the rear, fronting on Great Hay Road, is zoned R-3 <br /> Residential and is just over 30,000 sq. ft. in size. <br /> However, under the provisions of Section 174-11 of the Mashpee Zoning By-law, <br /> "When a lot is transected by a zoning district boundary, the regulations of this chapter <br /> which shall be applicable to each portion of the lot shall be those applicable to the <br /> zoning district in which it lies, provided that such portion shall have a land area <br /> sufficient to meet the minimum lot size requirement within said district. Where such <br /> portion or portions of said lot do not meet the applicable minimum lot size <br /> requirement, they shall be governed by the zoning applicable to the adjacent portion <br /> of the lot, if any, which complies with the minimum lot size requirement applicable to <br /> the district in which it lies."As the R-3 portion of this lot does not meet the 40,000 sq. <br /> ft. minimum lot size requirement for that zoning district, it is therefore considered to <br /> be governed by the 1-1 zoning applicable to the larger remainder of the lot, which <br /> does meet the 1-1 minimum lot size requirements. <br /> It should also be noted that the lot, as laid out on the "Subdivision Plan Prepared for <br /> Haystacks Realty Trust of Assessors Lots 29 & 30 Industrial Drive, Mashpee, MW <br /> rev. date 11-0-2000, by J.E. Landers-Cauley, P.E. and signed as a definitive <br /> subdivision plan by the Planning Board on December 20, 2000, obtains its legal <br /> frontage on an as-yet-to-be-built cul-de-sac street named "Industrial Drive Extension" <br /> (plans for which are available in the Planning Department office) and is not allowed to <br /> access Great Hay Road. This plan was prepared as part of an agreement between <br /> the Town and the owners of the old lots 29 and 30 wherein the Town rezoned the <br /> parcels from R-3 Residential to primarily 1-1 Industrial (the remaining 100 foot strip <br /> was intended at that time to ensure a buffer area from the Greenwood Estates <br /> subdivision across Great Hay Road), the owners merged a previously-existing 2-foot <br /> wide protective strip along Industrial Drive (which prevented access from this land <br /> from Industrial Drive) into the 3 lots created from the previous 29 and 30 (30 was <br /> 0 Page 1 <br />
