Mr. Tavares has no yet decided if he is going .
Paul said it would be helpful to Committee members if he or a
representative of his company were there.
Ian asked if his fee included all expenses, will there be any additional
costs?
Mr. Tavares said that is an all inclusive fee.
Paul said unless the Committee makes some special request, the fee is based
on the value of the purchases.
The Committee thanked Mr. Tavares.
Paul explained that at one time the Committee considered doing some
purchasing themselves. Paul spoke to Mr. Tavares about this and he is only
willing to exclude the technology items from his contract. The group 2
requires only 10-15% of his efforts, all the effort is in the group 3
although they do not have a lot of value. If the Committee wanted to
exclude Group 2 he would have to restructure his fee to reflect that.
The one other candidate SMMA expected to bid is too busy to take the job.
Mr. Tavares is also very busy; he doesn ' t need the business.
Peter will put the New Orleans trip on the next Selectmen's agenda. He
suggested Merry Sue and Janice come to the meeting to offer explanations .
LAND ACQUISITION SUBCOMMITTEE REPORT
Paul explained they met with Town Counsel earlier today. He is preparing
an offer letter to the owners. The deadline for their response, or for the
Town to take the land by eminent domain is December 12 , 1994.
Paul cannot comment or discuss the offer at this time. It seems a fair and
equitable offer.
Peter explained the Committee will soon get official notification from the
Performing Arts Center that they will not be using that site. There will be
no land swap.
Dan Solien asked what portion of the Cornish property will they acquire?
Paul said all of it.
Paul asked Tom Wren if he looked into the Com Electric easement issue? Bob
Fournier is going to pass that issue to Dan Solien.
Paul explained there is an easement, owned by Com Electric, across the
property. The Town is going to ask them to give that up.
Dan said several months ago he was told verbally by Com Electric that is
was not currently in use and to plan the property without regard to it. He
has now asked for something in writing from them and it has not been easy
to get an answer. They want the Town to provide a deed describing the
easement.
Paul said Bob Whritenour has that deed . Dan should call town counsel
directly and work together to get this resolved.
Dan said ComElectric has been reasonable but said they could not do
anything until they got the deed .
Dan asked if a land acquisition plan is necessary?
Paul said Town Counsel said it is. He should talk directly with Town
Counsel .
5
