n
Mashpee will have to pay them.
The Committee can tell them these numbers are unrealistic and go
back and re-do it ; negotiate.
Peter asked why they didn ' t tell the Committee they were
approaching the limit on meetings .'
Paul said right or wrong , the Committee continued to schedule
meetings beyond the 21 meetings .
Before any further negotiating or settlement , this should be
reviewed by town counsel .
Peter asked if SMMA would be coming to the Committee if the job
came in over?
Paul asked , however, did they spend the hours and did the town
get value from that work'
•. Peter said SMMA is divorcing themselves from all responsibility.
from Daedulus . They are not concerned about Daedulus ' error.
Cape Cod Commission : Paul explained they wanted $10 , 000 in their
original proposal but it was cut .
Peter asked if we didn ' t already spend an additional $70 , 000 for
the EIR? How do you know it wasn' t rolled into that process?
Agency Approval : Paul does not want to give them $18 , 000 but
there were a lot of extra meetings .
Steve said the 2 engineers created some extra hours but the
approval process moved smoother than he imagined . Their
engineers resistance to the unapproved plan caused the Committee
grief.
( Joe left the meeting at 6 : 40 p. m . )
Peter asked if the Committee has to pay for making them more
efficient , is it; our fault?
Paul said seeking approval for an unpermitted plan was never
discussed during negotiations . They bid the job having had no
meetings with the Committee .
Paul said the question is did they perform the extra work to
provide the savings to the end product? If it goes to
litigation, he thinks we will have to pay them.
Value Engineering : Everyone had a problem with this entire
issue . The Committee does not feel they are entitled to more .
Design Studies : The Committee did not pay them to design a pool .
. ---- They asked SMMA to look at incorporating the WWTP into the
building but the engineer said not immediately.
Steve does not see anything ( from their list ) that is not within
the normal bounds of a design.
Merry Sue said a lot of elevations were done because of the
budget .
Paul said the original contract states how many renderings they
will provide . The town did get a discount on the roofs and
6
