r
had proposed using them on Mashpee ' s project .
Peter said it is not fair to place this all in the Committee ' s
lap. He agrees with Bill , when approaching the limit , they
should have advised the Committee instead of socking us with a
bill .
Ed said it is their job to assist the Committee in getting the
school they wanted . Mashpee has more playing fields , classrooms
and technology than any other school that SMMA is doing . This
Committee has stretched all the standards . The issue is should
Mashpee keep all the value or should SMMA be compensated for
their• efforts .
Peter said the Committee helped them get it . also , they have to
spend money to put things back in that shouldn' t have been taken
out . 15% is not a reasonable variance ( from the cost estimator ) .
6 . Changes After Approvals .
There is a provision in the contract regarding this issue . 50%
of the drawings changed .
Merry Sue asked what approval is' If the Committee approved it
without knowing what it looked like then they didn ' t have enough
information for approval . For example , orientation of
classrooms , when did we approve that? She wouldn ' t have approved
a classroom without: connecting doors . There were changes because
it was the first time they saw things in detail . There were many
cases the Committee never talked about specifics .
At this point. the architects and Project Manager left the room so
the Committee could try to reach consensus about this issue .
Janice said she is annoyed that the tone of their presentation is
that this is the fault of the Committee . She thinks they under
estimated the Committee .
Peter explained , when they negotiated SMMA ' s contract , they
squeezed them hard and now they want to make it back.
Steve thinks they already paid them top dollar on their original
contract .
Paul said the Committee did give approval to go to the next-' :
phase , but there were never a set of drawings to sign off on.
They probably jumped ahead .
Paul said their contract does stipulate 21 meetings not 40 but he
has a problem with them taking an average for the extra meetings ;
they assumed they were all .4 hours and they weren' t ; they used 2
hours , not .1 . 5 hours for travel time . .
Peter said the Committee does not have to re-act to this . SMMA
cannot stop providing services . There is no benefit is b-eingreactive . "
Paul said they could bill us . We could go to court . If it goes
to court , according to their contract , they will probably win and
5
