Seeley : <br /> This letter will confirm our telephone conversation of June <br /> 19, 1995 in which I stated my opinion that the provisions of the <br /> Town' s earth removal by-law, Chapter 82 of the Mashpee Code, are <br /> not applicable to the grading and earth removal operations to be <br /> conducted in connection with construction of the new high school . <br /> Section 82-4 of chapter 82 specifically exempts from its <br /> provisions land in public use and materials removed or excavated <br /> for construction of buildings and the making of public <br /> improvements . <br /> I trust that this letter will address the concerns raised by <br /> Stone Building Company in its correspondence to you dated June <br /> 17, 1995 .
